💡 In case you missed it - legal changes have come in that affect how deprivation of liberty is determined and safeguarded.

This now means that consent to care arrangements which include a deprivation of liberty could be inferred for a person who has been assessed as lacking mental capacity.

We must also see concrete steps to establish protections and safeguards for people as a result of these changes, to ensure their fundamental human rights are protected.

🗞️ Great to see social care coming up as a a policy issue worth championing in the potential Labour leadership conversations.

Too often social care is overshadowed by other issues in the campaigning space, despite it having a huge economic impact, work opportunities and, most importantly, delivering essential care and support for hundred of thousands of people.

Any changes within the Government must ensure that the Casey Commission progresses with urgency, so that people are protected and enabled to live their lives grounded in their fundamental rights.

⚖️ Yesterday the Supreme Court made a ruling which will change how it is determined that someone has been deprived of their liberty.

This now means now means that consent to care arrangements which include a deprivation of liberty could be inferred for a person who has been assessed as lacking mental capacity.

We are concerned about the implications of this decision on the rights of people in vulnerable situations. The implication that deprivation of liberty safeguards would no longer be applied is worrying and would put many people who we support through our adviceline at risk.

We need the Government to urgently issue clarification and guidance about how this judgment interacts with the existing code of practice, to ensure care and health providers, local authorities and people affected understand the consequences.

We must also see concrete steps to establish protections and safeguards for people as a result of these changes, to ensure their fundamental human rights are protected.

🗞️ We're in The Telegraph today spotlighting the rise of revenge evictions for people in care homes.

Care home residents have weaker rights than tenants when it comes to eviction. Care homes are only required to give residents 28 days’ notice.

Lauren Byrne, of Care Rights UK, said: “Our advice line hears of people receiving notices to quit from their care provider every week.

“Most commonly, the reason given will be that the care provider is no longer able to meet that person’s needs.”

Ms Byrne said she had come across cases where the care home evicted a resident, claiming it could no longer meet their needs, but this was shortly after the individual or their family had issued a complaint.

“Revenge evictions are unacceptable and put a huge amount of strain on the person with care needs,” she added.

📺 This week the BBC is spotlighting the work of carers in Caring Matters week.

It's really important to see more visibility of the vital work and support that is carried out by unpaid carers across the country, often without the right support.

We support many people who find themselves in the position of caring for a loved one, with no idea what it would be like until they are in it.

This week also sees actress Natalie Cassidy train to be a care worker, inspired by her experiences with her dad's care.

We were glad to be involved in briefing the production team about what gaps there are in training for care workers, and wider issues with the social care system.

🔥 This weekend is set to be a scorcher! Hopefully this means time outdoors to be enjoyed for people receiving care.

It's also an important time to check that your care home is adequately prepared to handle the heat, in order to keep people safe.

We recommend:

- Reviewing your room and talk to care staff about potential problems
- Check with care staff what action they are taking to protect residents
- Ask about plans to safeguard residents over the weekend when staffing levels may be lower and managers may be absent

💡 Dementia Action Week is also an important time to consider actions you can take to make things easier for you in the future, like setting up Lasting Power of Attorney (LPA).

Putting in place a power of attorney can give you peace of mind that someone you trust will be able to make decisions about your health and welfare if you are no longer able to do so (referred to as ‘mental capacity’).
