Managing Emerging AI Risk
Artificial intelligence is transforming the insurance landscape. Companies deploying AI face a rapidly shifting coverage environment: insurers are endorsing standard-form policies that silently cover covered AI-related losses to exclude AI-related losses, and new types of AI-specific claims—from algorithmic discrimination to AI-assisted professional errors—are testing the boundaries of traditional CGL, E&O, EPL, D&O, and cyber coverage. At the same time, insurers themselves are deploying AI in underwriting, pricing, and claims handling, raising novel questions for risk managers when algorithms replace human decision-making.
This session traces the emergence of AI risk through a lens that will be familiar to risk managers involved in the emergence of cyber risk and coverage: the same progression from silent coverage to coverage disputes to exclusions to dedicated products is playing out again, but with a twist due to insurers’ own reliance on AI. This session walks through the coverage disputes already underway, the exclusions arriving at renewal, coverage for AI risks under current policies and future AI specialty coverage, insurers’ use of AI and its impact on policyholders, and the steps risk managers can take now to protect their organizations.
