Lois Kolkhorst on PBM clawbacks: “I do not understand, for the life of me, how someone distributes a prescription… and then months later, even a year later, somebody can come back and say, ‘Oh, we overpaid you for that, and we’re going to take a bunch of money out of your coffers.’ That is like a psyop. "Rural Texans should not have less access to timely health care simply because Texas maintains outdated restrictions," TPA member and independent Crystal McEntire told the Texas Senate Health & Human Services Committee today. "The Cicero Institute recently scored Texas just 3 out of 10 on pharmacist practice authority, placing Texas among the most restrictive states in the country. That low score also negatively impacted Texas applicants pursuing the CMS Rural Health Transformation Program because it reflected the limited flexibility pharmacists have to help meet rural health care needs."

During today’s Texas Senate Health and Human Services Committee hearing, Senator Molly Cook, a nurse, said it is part of her workflow to ask her patients what they use. “When it’s an independent pharmacy, 100% of the time they love it. They will gush about their pharmacy,” Cook said. “It’s a really top priority to me to keep independent pharmacies across the state open, and I hope it is for the committee as well.”

"Independent are closing at a rate of at least one per week—not because patients need fewer medications, not because competitors can provide care less expensively, but because vertically integrated PBMs have discovered they can systematically underpay independent pharmacies while overregulation limits our ability to adapt and expand services," said TPA Independent Pharmacy Academy Chair Crystal McEntire. "The path that we are on is unsustainable."

McEntire was invited to testify today before the Texas Senate Health & Human Services Committee and Chair Lois Kolkhorst as it examined the role of PBMs in health care costs and monitored the implementation of SB 1236, passed last year.
