In an extraordinary decision affecting mentally incapacitated people confined to care homes, the UK Supreme Court has unanimously overturned its own ruling in the pivotal Cheshire West case (P v Cheshire West and Chester Council & Anor, [2014] UKSC 19).

In the original case, the Supreme Court held by a majority that the test for a deprivation of liberty, under article 5(1) of the European Convention on Human Rights, is whether an individual is subject to continuous supervision and control and not free to leave.

In a confirmatory decision, the Court of Appeal for Ontario recently ruled in favor of respondent Tiffany Jean, who was appointed as co-trustee to her late grandfather Warren Holbrook's estate (Staples v Jean, [2026] ONCA 369).

The dispute arose following the passing of Warren Holbrook on December 3, 2021. Holbrook named his three daughters, Rebecca Staples, Maureen Sherk and Jennifer Holbrook, as residual beneficiaries of his primary and secondary wills, with his granddaughter, Tiffany Jean, being named as co-trustee of his estate.
