“Boulder deserves to have our day in court to hold these corporations accountable for the costs our community is having to bear,” said Micah Parkin, co-founder and executive director of 350 Colorado.

Justices questioned both sides over whether Boulder can seek climate damages under Colorado law, as local officials and residents rallied behind the eight-year case.

"Micah Parkin, 350 Colorado’s executive director, pointed to the 2013 flood — which destroyed 345 homes, damaged 557 others, killed four people and forced the evacuation of more than 1,800 across Boulder County — and the area’s increasingly destructive wildfires, including the Marshall Fire. The 2021 Marshall Fire destroyed more than $2 billion in property, including more than 1,000 homes, and killed two people.

Parkin said the rally is an opportunity for the local community to show support for Boulder and Boulder County in the case. The rally, she added, will be an opportunity for community members who have been directly impacted to share their stories.

“Our community has suffered terribly from the worsening wildfires and floods,” she said. “These companies knew and chose to obfuscate the truth in order to protect profits. We deserve to have our day in court. We shouldn’t have to be shouldering the burdens of these costs alone.”

As the U.S. Supreme Court on Monday takes up a landmark Boulder County case on local governments attempting to hold oil companies financially liable for pollution, local environmental activists are planning a rally in downtown Boulder.

Boulder is suing these companies to hold them accountable for concealing the dangers of their fossil fuel products and to make them pay for local climate damages, including more destructive fires, droughts, and extreme heat. The Colorado Supreme Court has already ruled that the case should move toward trial. Now Big Oil wants to stop it before we can present the evidence.

Exxon and Suncor have known the consequences of their products for more than 50 years, yet they kept promoting and selling them. Colorado communities now face billions in damages, like the $2 billion Marshall Fire, while these companies rake in record profits. Why should we shoulder the costs?

The City and County of Boulder, Colorado, are suing ExxonMobil and Suncor Energy to hold them accountable for concealing the dangers of their fossil fuel products and to make them pay for the resulting local climate damages.

Last year, the Colorado Supreme Court ruled that Boulder’s case should proceed toward trial. Now, Big Oil wants the U.S. Supreme Court to stop the case before the people of Boulder have their day in court.
