In a victory for cleaner air & healthier homes, a federal appeals court delivered a landmark ruling last week upholding New York City and New York State laws that require buildings to reduce pollution from buildings.

The decision affirms a growing consensus that states and cities have the authority to advance policies that reduce harmful pollution, improve public health, and help build cleaner, healthier communities.

called the ruling “a welcome return to a commonsense understanding of state and local control over the homes we live in and the air we breathe.”

As fossil fuel corporations continue to fight against laws that make our homes safer and more comfortable, New York must continue to be a national leader by advancing energy efficiency and climate policies that lower costs and improve air quality.

For too long, New Yorkers have been forced to pay for new gas pipe hook-ups through extra charges on our bills. These charges cost us $600 million every year and drive up everyone’s gas bills. The 100-foot rule repeal ends these extra charges to save New Yorkers money and stop lining the pockets of gas utility shareholders!

Last year our movement achieved a big win for energy affordability and climate action when the 100-foot rule repeal passed the legislature and Governor Hochul signed it into law. The law goes into effect later this year. Draft regulations were just released by the Public Service Commission, NY’s utility regulator. We need to show widespread public support for the draft regulations!

On Governor Hochul’s Climate Law Rollbacks:

“At a time when we are facing an energy affordability crisis caused by our dependence on fossil fuels, it’s unconscionable that Governor Hochul has undermined New York’s best chance to transition to clean, affordable energy,” said Lisa Marshall on behalf of the Renewable Heat Now Campaign.

“The impact of weakening New York’s Climate Law will be felt by families in the form of higher energy bills, increased air pollution, and the worsening of the climate crisis. The winners of gutting the Climate Law, however, will be utility companies and fossil fuel corporations that have lobbied against climate action in order to continue to profit from selling fossil fuels and investing in more fossil fuel infrastructure. Every New Yorker should be outraged that Governor Hochul put profits over people.“

We are heartbroken, yet we remain determined to continue our work to build resilient communities with cleaner air, healthy homes, lower energy bills, and good union jobs can and must continue.
