The trial of Yorgen Fenech for Daphne’s assassination has proven once again what the public inquiry concluded in 2021: that high-level corruption created a culture of impunity and a powerful network within government, state authorities, and business that violates good governance and undermines the public interest.

Yorgen Fenech had full access to politicians and public officials who were willing to serve him rather than the common good. This includes the current Planning Authority CEO, Johann Buttigieg, as well as former Police Commissioner Silvio Valletta, who until this day, still receives his Police pension, paid from public coffers.

While heading the PA, Johann Buttigieg stated “we can do business whenever you want” (“meta trid nagħmlu negozju”) in reply to Yorgen Fenech, who said on WhatsApp: “I’ll steal something off him. We’ll divide it between you and me, and do business together” (“Nisraqlu xi ħaġa irrid. Naqsmuhom jien u int u nagħmlu negozju”). This alone should have led to his permanent removal from the PA. However, the institutional rot evidenced by the chats goes far beyond this matter.

The Planning Authority must be cleansed of any corruption, as must all other government entities and state authorities.

We second other NGOs’ calls for Government to:
1. Immediately remove Johann Buttigieg from his role as CEO, and to prohibit him from holding any public office;
2. Launch an independent investigation, led by an independent authority;
3. Enact legislation that requires all Planning Authority comms to use official channels only.
4. Establish a transparency register to record all meetings between officials and interested parties.

We also reiterate our call to the Government to implement all the recommendations of the 2021 public inquiry, such as the recommendation for the introduction of laws against:
1. unexplained wealth
2. public officials who hinder criminal investigations
3. abuse of public office
4. mafia-style criminal associations.
