“The executive order and current actions by DHS and USPS to implement it are confusing voters and harming voting rights groups just as they and state and local officials are preparing for the 2026 elections.”

A federal court today ruled that nonpartisan voting rights groups could continue with their legal challenge to President Trump’s executive order restricting mail-in voting ahead of the upcoming 2026 primaries and November midterm elections.

"The League of Women Voters strongly condemns Congress’s passage of the budget reconciliation package, which pours billions of additional taxpayer dollars into US Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP) without installing critical guardrails for accountability, transparency, or civil liberties protections. This violates constitutional protections, including the right to due process and First Amendment freedoms.

The League of Women Voters issued the following statement on Congressional passage of funding for immigration enforcement agencies:

“State election officials could soon face a stark choice: Hand over voter lists to the Trump administration or risk losing Postal Service delivery for mail-in ballots.”

“State election officials already have the ability to use a DHS immigrant record system to verify their rolls, and the program has come under fire for falsely identifying eligible voters as non-citizens.”

State election officials could soon face a stark choice: hand over voter lists to the Trump administration or risk losing Postal Service delivery for mail-in ballots.

“The League of Women Voters of Indiana, Common Cause Indiana, Hoosier Asian American Power and Exodus Refugee Immigration hired an election methodology expert to crunch state challenge data.”

“”Absent an injunction, these violations will continue to unlawfully prevent U.S. citizens from registering to vote and voting,” the plaintiffs wrote in a supporting memo. They are represented by the Chicago Lawyers’ Committee for Civil Rights.”

Voting rights advocates submitted the data as part of their request for a preliminary injunction against the state's proof-of-citizenship law.

“The order, titled “Ensuring Citizenship Verification and Integrity in Federal Elections,” says that states can send the U.S. Postal Service a list of voters “to whom the State intends to provide a mail-in or absentee ballot” 60 days before any federal election, and directs the Postal Service to create “unique ballot envelope identifiers, such as bar codes” for those voters.

The Postal Service would only be authorized to deliver ballots from people on an approved list, which states would be allowed “to routinely supplement and provide suggested modifications or amendments” to.”
