Micromobility — especially e-bikes — have exploded in popularity recently. But what’s allowed on our streets? What counts as an ebike? How are we determining what can and can’t be on our streets?

Class 1 e-bikes have working pedals and a motor that only provides assistance when pedaling, with a max assisted speed up to 20 mph.
In NJ, these devices are classified as Low Speed Electric Bicycles and require licence and registration.
Usage: NYS, NYC, NJ, CT
Class 2 e-bikes have working pedals and a motor that can exclusively propel the bicycle without pedaling, with a max assisted speed up to 20 mph.
Usage: NY State, NYC, CT
In NJ, some of these devices, including throttle e-bikes with a max speed of only 15 mph, are considered Motorized Bicycle/Mopeds and, in addition to license and registration, also require insurance to operate.
Class 3 e-bikes have working pedals and a motor that can exclusively propel the bicycle without pedaling, with a max assisted speed up to 25 mph. In New York State, Class 3 e-bikes are only legal in NYC, and nowhere else in NYS. In CT, Class 3 e-bikes are pedal assist-only, with no throttle and a max assisted speed of 28 mph.

In NJ, these devices are considered Motorized Bicycle/Moped and require license, registration, and insurance.
NJ has the most restrictive laws for e-bikes in the country. This has led to a “cooling effect” for people who use micromobility devices in the Garden State.
In NYS, NYC, and CT an electric scooter is a device with handlebars, a floorboard or a seat, and an electric motor that can be powered by the electric motor and/or human power, with a max speed of 20 mph.
NJ distinguishes between Low-Speed E-Scooters, capable of reaching maximum speed of less than 19 miles per hour, and Motorized Scooters, which can be gas-powered or electric, with a max speed up to 15 mph
