Good news: Duke to Refund $30 Million to Ratepayers in CAC Coal Ash Victory!! 🔥🥳💪

The Indiana Utility Regulatory Commission issued an order in Cause Number 42061 ECR 45 directing Duke Energy Indiana to refund $30 million to customers over the next six months, while also preventing it from charging certain coal ash cleanup costs to ratepayers in the future.

In total, CAC’s advocacy saved Duke customers more than $60 million in coal ash cleanup costs. No action from customers is needed to receive the refund, as it will automatically be applied to electric bills going forward as a component of the Environmental Compliance Adjustment tracker.

The case stems from a CAC victory at the Indiana Court of Appeals last year that had challenged Duke Energy Indiana’s massive coal ash cleanup spending that did not receive prior IURC approval. In this proceeding, the IURC determined how to implement CAC’s court victory. Thankfully, the IURC heeded CAC’s urging to reject a particularly greedy Duke proposal that would have given its shareholders an extra $20 million in coal ash insurance proceeds at the expense of Duke customers.

Need a place to cool down? Indy Parks cooling centers and Indianapolis Public Library locations are available during regular operating hours.

Plan ahead now and take precautions:
• Stay hydrated and limit strenuous outdoor activity
• Take frequent breaks in air conditioning
• Check on older adults, neighbors and others who may need assistance
• Never leave children or pets in a parked vehicle

In October 2024, CAC became the first organization in the nation to call for a moratorium on large data centers, based on our analysis of the significant harms caused by these facilities.

Since then, the projections have only gotten worse for Indiana, demonstrating our concerns were not only valid, but understated.

We have since been joined by 26 Hoosier organizations and more than 500 organizations across the country in calling for a data center moratorium.

Hoosiers are also rising to the occasion to defend their communities. Many thousands have attended public meetings and protests, contacted their elected officials, put up signs, knocked on doors, spoke at hearings, submitted written comments, and spread the word on social media.

We certainly need some data centers to enable the internet, cloud storage, social media, and other beneficial uses. But the process, pace, and purpose of the current AI-fueled data center frenzy are completely unsustainable, unaffordable, and a disaster for Indiana communities. It benefits a few to the considerable detriment of the many.

Updated data center moratorium map from Environmental Resilience Institute at Indiana University!

In August, Marion County became the latest county in Indiana to adopt a moratorium on data centers.

At least 40 counties to date have passed some kind of data center ordinance, including:

🟢 13 regulatory ordinances
🟡 24 moratoriums
🔴 3 bans

ERI recently updated its data center fact sheet to inform public discussion across the state concerning the environmental impacts of these facilities and the legal requirements developers must follow.
