On August 13, 2026, a federal district court ruled in Idaho that the 14th Amendment protects the right to abortion when a pregnant person’s life or health is seriously threatened, blocking Idaho from enforcing its abortion bans in those circumstances.

The ruling invalidates two Idaho laws to the extent that they prohibit doctors from providing abortion care to patients facing serious medical conditions, including mental health conditions that put them at risk of su***de or overdose.

Following a six-day trial in June, the court determined that abortion care to prevent serious and lasting harm to a pregnant person’s health is deeply rooted in American history and tradition. The decision is the first federal court ruling since the overturning of Roe in 2022 to recognize that the federal Constitution continues to protect abortion access in certain circumstances.

The case was brought by the Lawyering Project and Legal Voice on behalf of Dr. Stacy Seyb, an Idaho maternal-fetal medicine specialist who argues that the state’s abortion bans prevented him from providing necessary care to patients.

Early Monday morning on August 10, 2026, Massachusetts Governor Maura Healey signed the Prioritizing Patient Access to Care Act into law, expanding access to abortion later in pregnancy and removing the state’s previous 24-week gestational limit. Under the new law, healthcare providers can determine whether abortion care is medically appropriate based on their professional judgment.

Previously, Massachusetts law generally limited abortion access to the first 24 weeks of pregnancy, creating a significant barrier for those seeking later-stage care. After that point, physicians could provide abortion care only under limited circumstances, including when necessary to preserve a patient’s life or physical or mental health, in cases of a lethal fetal diagnosis, or when the fetus was unlikely to survive outside the uterus.

Even within these exceptions, patients were sometimes denied care. State Representative Christine Barber shared that hospitals were still denying patients access to abortions, even when a fetus was determined unlikely to survive outside the uterus. As a result, Massachusetts patients were forced to leave the state, sometimes as far as the Southwest, to access the care they needed.

Andrew and Tristan Tate will appear before a U.S. magistrate judge on Thursday, August 13, as they seek release from federal custody while they await potential extradition to the United Kingdom.

The Tates’ lawyers have filed to release the brothers, writing that it would be “extraordinarily difficult for [them] to travel undetected or avoid attention.” Their attorneys have asked U.S. Magistrate Judge Lauren Louis to release them on bail in exchange for surrendering their passports and agreeing to location monitoring.

The Tates, who hold dual U.S. and British citizenship, were arrested in Miami on July 18 while traveling to a bare-knuckle boxing match that Andrew Tate was supposed to co-host. The arrests came after the U.K. Crown Prosecution Service (CPS) requested their extradition following additional allegations from four new survivors.
