Texas h**p policy is at a crossroads. On Friday Sep 25th, Cynthia Cabrera, Chief Strategy Officer at Hometown Hero, will join High Stakes at the Texas Tribune Festival to discuss how changing rules have affected the h**p industry and how THC should be regulated in Texas.

We believe effective policy should keep these products out of minors’ hands while protecting Texas jobs, responsible businesses, and adults’ freedom to make informed choices. Cynthia will bring the industry’s perspective to this important conversation.

The State filed its reply brief on September 17 in THBC’s lawsuit challenging portions of the new Texas consumable h**p rules.

THBC’s brief, filed on August 14th, is arguing for the injunction to be reinstated and why the entire case should not be appealed.

The State continues to frame this case as a disagreement over THC testing and whether h**p should be regulated. THBC’s challenge is narrower: Did the agencies replace the compliance standard enacted by the Legislature, and did they complete the economic analysis and reasoned justification required by Texas law?

The reply also argues that the trial court’s injunction was too broad. But the State acknowledges that it did not specifically frame that objection in the trial court, instead arguing that broader separation-of-powers statements preserved the issue for appeal. THBC believes that leaves a significant preservation question for the Court.

The next step is a submission notice telling the parties whether the appeal will be decided on the briefs or scheduled for oral argument. Both sides have requested argument.

For now:

• The DSHS rules remain enforceable.
• The lawsuit remains active.
• No final merits ruling has been issued.
• There is no deadline for the court to make a decision.

GOOD NEWS FOR H**P: We just gained four more weeks.

Today, the U.S. House of Representatives passed the federal funding bill containing a 4-week extension of the current federal h**p definition, delaying the federal h**p ban currently scheduled to take effect on November 12.

The bill passed the House 370–48, after previously passing the Senate 90–6. It now heads to President Trump’s desk.

If signed into law, the effective date of the new federal h**p restrictions will move from November 12 to December 11, giving Congress additional time to work toward a long-term solution for the h**p industry.

This is not a permanent fix, and our work is far from over. But every additional day gives our industry more time to advocate for a regulatory framework that protects consumers, supports farmers and small businesses, and preserves access to legal h**p products.

Over the last several weeks, h**p businesses, advocates and consumers across the country have made their voices heard, and we can’t let up now.

We now have four more weeks to keep fighting for a solution based on responsible regulation.

At our recent fundraiser, an individual decided to help himself to several items from our silent auction.

Unfortunately, these weren’t unclaimed items. They had already been bid on and paid for by attendees by the time we realized they had been taken.

We have clear video footage of the individual involved, and we’re asking our community for help identifying him. We believe he may be in the Austin area.

If you recognize this person, please contact us privately with any information that may help confirm his identity. Once identified, we intend to alert event organizers and businesses in our community so they can make informed decisions about allowing him at future events or establishments.

We would prefer to resolve this simply: return the stolen items or pay for what was taken.

Our fundraiser was built around businesses and individuals coming together to support this industry. Stealing from that community—and from the people who paid for these items—is unacceptable.

If you know who this is, please DM us. Do not harass or confront the individual. Just send us the information.

As Luis reminds us, h**p is about more than an industry — it’s about wellness, choice, and creating better options for people.

The fight for h**p is far from over. And with businesses, advocates, consumers, and supporters standing together across state lines, neither are we.
