203 people sentenced to death have been exonerated since 1973 – that’s 1 innocent person exonerated for every 8 that the U.S. executes. People of color, people with intellectual disabilities, and LGBTQIA+ people face disproportionate risks of being sentenced to death. Beyond these facts, research has found little evidence that fear of the death penalty deters crime. If it doesn’t make our communities safer, what purpose does the death penalty serve?

No-crime cases are crimes that never occurred (e.g., an accident or act of self-defense). Women are wrongfully convicted of no-crime cases at 2x the rate of men. The National Registry of Exonerations have recorded that women have lost a total of 747 years to wrongful incarceration for no-crime cases.

In 2024, the current District Attorney and judge that presided over her original case found that the prosecution had suppressed evidence, and recommended her conviction be overturned. On Thursday, the Texas Court of Criminal Appeals rejected the trial court’s finding of constitutional error. Melissa Lucio remains on death row.
