The good news keeps on coming! Protect the Clearwater received a positive ruling, and Judge Halligan expanded on the earlier ruling from our Judge. Most importantly, Judge Halligan found the abbreviated pit permitting process to be unconstitutional.

In her ruling, Judge Halligan stated:

“Rather than fulfilling this continuing obligation, DEQ manufactured a conflict between the statutory time constraints and the constitutional purpose of the Opencut Mining Act, and then resolved that conflict by subordinating the Montana Constitution. That the Permit was issued on the same day as the environmental assessment only underscores the absence of any meaningful review prior to approval of the Permit.”

We want to share an important update. We have officially filed our legal brief seeking reimbursement of our attorney’s fees under the Montana Environmental Policy Act (MEPA) following our legal victory last year.
That victory happened because of you.

Many of you showed up and spoke at the initial 2023 DEQ public hearing, raising serious concerns about potential impacts to our community. Because of that overwhelming public participation, the court found that the Department of Environmental Quality (DEQ) violated the public’s constitutional right to participate in the review process.

The judge’s ruling affirmed what our community already knew, the public must be allowed a meaningful opportunity to review and comment on environmental decisions that affect our water and our future.

Seeking reimbursement of our legal fees is an important step in holding agencies accountable and ensuring that citizens are not financially punished for standing up for environmental protections that the law already requires.
Simply put, this victory happened because people like YOU showed up and spoke up.

For some, that refund might mean a small financial cushion, paying down a bill, or putting something aside for the future.
