It took a massive effort, but this couple got a decent payout from KMart over unsafe play sand. If you need help taking something to the Disputes Tribunal, your local CAB can help.

Thousands of New Zealand families bought recalled play sand from Kmart. Many customers were told the risk was low and were only offered a refund.

Despite this, Christchurch parents Ella and David spent nine months collecting evidence, paid thousands of dollars in costs, and took Kmart to the Disputes Tribunal. This case shows how hard it can be for consumers to get compensation when a product turns out to be unsafe.

Consumer NZ thinks this highlights fundamental gaps in the product safety space in New Zealand, and would like our government to take a more proactive approach with the risks that we face in our marketplaces.
