NAACP Challenges Federal Intimidation of California Election Officials and Interference with Ballot Counting Under the Voting Rights Act• Service Employees International Union v. Department of Justice (U.S. District Court for3Northern District of California): This case involves threats by federal government officials to state and local election workers that interfere with the counting of ballots in accordance with federal and state law in California. The Department of Justice (“DOJ”) and the Department of Homeland Security have engaged in a coordinated campaign to intimidate, threaten, and coerce state and local officials by threatening the criminal prosecution if they process and count ballots using procedures required by federal and state law. This case is being filed after DOJ issued subpoenas to local election officials. Among several allegations, this case is brought under Section 11(b) of the VRA. It is seeking emergency relief. State of Alaska (U.S. District Court for the District of Alaska): National NAACP and the NAACP Alaska Oregon Washington State Area Conference submitted a proposed amicus brief in this case arguing that the National Voter Registration Act (“NVRA”) does not authorize the federal government to challenge the certification of election results based on a candidate’s placement on the ballot. The brief explains that the NVRA is focused on expanding voter registration and maintaining accurate voter rolls—not determining candidate qualifications, regulating ballot design, or preventing certification based on which candidate wins. The organizations further argue that the relief sought by the federal government would improperly second-guess voters’ choices and could result in eligible voters’ ballots being disregarded, including ballots already cast by NAACP members in Alaska. The brief emphasizes that Congress enacted the NVRA to remove barriers to voter participation, particularly those historically used to suppress Black voters and other marginalized communities, and that authority over the administration of congressional elections rests with the states. NAACP Intervenes in Lawsuit to Push Back Against DOJ Attempt to “Segregate” Thousands of Mail Ballots in California• United States of America v. State of California (U.S. District Court for the Central District of California): On October 28, 2026, the Court denied the government’s request for a temporary restraining order seeking to require California election officials to identify and segregate ballots cast by approximately 20,000 registered voters alleged to be noncitizens. The Court found that the government failed to establish the necessary grounds for emergency injunctive relief, questioning the reliability of its methodology for identifying alleged noncitizen voters. The Court further emphasized that the requested relief would impose substantial administrative burdens on state and county election officials, require significant changes to election systems and procedures, and risk disenfranchising eligible voters, particularly naturalized citizens. The Court also noted that the government had known about the alleged issue for months but waited until shortly before Election Day to seek emergency relief. On October 30, 2026, the government appealed the matter and the Ninth Circuit affirmed the district court’s denial of the government's ex-parte TRO motion. The decision underscores the risks of relying on unverified citizenship data to challenge voter eligibility and the importance of protecting eligible voters from improper ballot restrictions. NAACP Defends Private Enforcement Rights Under the Voting Rights Act• California Nurses Association v. Mullin et al. (U.S. Court of Appeals for the Ninth Circuit): The NAACP submitted an amicus brief as co-counsel with the NAACP Legal Defense & Educational Fund, Inc. and the Asian American Legal Defense and Education Fund in support of the Appellees to provide the Court with a comprehensive account of the history and legal authorities concerning private enforcement of the Voting Rights Act of 1965. In this matter, the DOJ is continuing to wage war on the Voting Rights Act. NAACP’s amicus argues that there remains a private right of action under Section 11(b) of the Voting Rights Act. This matter is being led by Associate General Counsel Max Meyers.

NAACP Files Lawsuit Over Department of Justice’s Election Monitoring Plan• NAACP v. Harmeet Dhillion (U.S. District Court for the District of Columbia): Following consultation of the parties concerning NAACP’s streamlined request, the Court ordered the Department of Justice (“DOJ”) to comply with processing NAACP’s FOIA request regarding the “election monitors.” On Wednesday night, the DOJ submitted a declaration that provided previously undisclosed information on the monitors this Election Day, notably that personnel from law enforcement agencies will serve as monitors. These individuals will be unarmed and the DOJ stressed they will not have the authority to conduct arrests or be serving in a law enforcement capacity. The NAACP is still pursuing the release of more records prior to Election Day from the DOJ. This matter is being led by Associate General Counsel Max Meyers.

NAACP Sues Texas Officials Over Withheld Voter Registration Records• NAACP et al. v. Robert Howden et al. (US District Court for the Western District of Texas): On October 26, 2026, NAACP National, the NAACP Texas State Conference, along with the Texas League of United Latin American Citizens (“Texas LULAC”) filed a complaint against the Texas Secretary of State and the Director of the Texas Department of Safety for violations of the National Voter Registration Act (“NVRA”). The lawsuit challenges Defendants’ failure to disclose records concerning significant voter registration processing delays, including a backlog of more than 500,000 voter registration applications. Plaintiffs had not received records requested on October 8, 2026, seeking information about the affected applications, transmission procedures, and remediation efforts. Plaintiffs allege that withholding these records impairs their ability to identify affected voters, provide voter assistance, and deploy election protection resources ahead of the general election. The complaint requests declaratory and injunctive relief compelling Defendants to produce the requested records. National NAACP and the NAACP Texas State Conference are represented by Southern Poverty Law Center. This matter is being monitored by Senior Associate General Counsel Anthony P. Ashton.
