Three years after a group of LGBTIQ+ individuals were threatened and one was attacked following EuroPride festivities in Gozo, the court has finally delivered its verdict. While we welcome the court’s acknowledgement that this attack was hate-motivated, we are deeply concerned by a massive systemic failure: Why wasn't this officially charged as a hate crime?
The court explicitly affirmed that this attack happened because of hatred toward the LGBTIQ+ community. Had the victim not been perceived as LGBTIQ+, this violence would never have occurred. Despite clear evidence, authorities originally failed to flag this as a hate crime. Instead of utilizing Malta's robust protective laws, the court found the aggressor guilty only of causing bodily injuries, making threats, and breaching public peace.
Malta’s equality laws are lauded globally, but are they genuinely reflected in practice, or do they just exist on paper? When this attack occurred, the Coalition was told it wouldn't be charged as a hate crime because the victim didn't explicitly articulate it as one. Expecting a traumatized victim to identify and verbalize specific legal infractions is an unfair burden. It is the duty of the investigating officers—as the judicial experts—to determine what law has been broken. We demand transparency on how law enforcement categorizes, investigates, and prosecutes these cases. Failing to charge clear-cut cases to the fullest extent of the law sends a dangerous message that hate-fueled actions will not be adequately litigated.
We call on our judicial system to ensure that hate-crime aggravates in the Maltese Criminal Code are actively and rigorously applied right from the charging phase. The state must prosecute hate crimes to the full extent of the law.
