To the Scarborough Code Enforcement Officer,
I am writing to file a formal municipal code complaint regarding a severe, ongoing safety hazard and dangerous property use at the address listed above. This property currently maintains an operational practice that results in a continuous, unchecked, and dangerous ICE presence in the Scarborough community.
This sustained hazardous condition constitutes a direct violation of the Town of Scarborough Zoning Ordinance, Section IX (Performance Standards), which mandates that industrial and commercial operations may only be conducted where there is "no unreasonable danger... or other hazard to health or safety."
1. Description of the Dangerous Use & Hazard
The continuous presence of ICE at this location presents a persistent, systemic operational presence and danger to our community.
ICE agents are poorly trained and fail to meet the basic safety standards and practices of law enforcement officers in the state of Maine. As demonstrated by the recent unlawful killing of an innocent citizen in the neighboring town of Biddeford and ICE's persistent refusal to address the unsafe manner under which its agents operate, their daily presence in Scarborough while transiting to and from 40 Manson Libby Road poses an unreasonable danger to the health and safety of Scarborough's citizens.
2. Specific Municipal Code Violations
This property is operating in direct conflict with the following local and state frameworks:
Scarborough Zoning Ordinance Section IX (Industrial/Commercial Performance Standards): The ongoing failure to mitigate a hazard creates a clear, unreasonable danger to public safety, invalidating the property's right to operate under standard district performance rules.
Scarborough Town Ordinances Chapter 611 (Public Disturbance & Safety): This continuous condition actively โendangers the comfort, repose, health, peace, or safety of others.โ
Maine Revised Statutes (30-A M.R.S.A. ยง 4302): Because this operation exists in ongoing violation of land-use safety thresholds, it constitutes a statutory Public Nuisance requiring immediate municipal intervention.
3. Evidence of Continuity
The hazardous ICE presence is a recurring, daily danger and is common knowledge to both the town's citizens and the Town Council.
4. Requested Action
Given that this continuous hazard presents an immediate threat to physical safety, I respectfully request that the Planning and Codes Department execute the following steps:
Conduct an immediate on-site safety inspection of the property, its operations, and its safety protocols.
Issue a formal Notice of Violation (NOV) to the property owner and tenant ordering immediate abatement of its operations.
If compliance is not met swiftly, issue a Cease-and-Desist order or levy civil daily fines under 30-A M.R.S.A. ยง 4452 to protect the Scarborough community.
