Daniel Ramos was an unsuccessful candidate for Victorville City Council, in the November 6, 2018 General Election and the successful candidate for the Adelanto City Council, in the November 3, 2020 General Election. Ramos for City Council 2018 and Committee to Elect Daniel Ramos Adelanto City Council 2020 (the “Adelanto Committee”) are Daniel Ramos’ candidate-controlled committees. Arsineda served as the Adelanto Committee’s treasurer. The Committees, Daniel Ramos, and Arsineda failed to timely file a statement of organization, sixteen semi-annual campaign statements, and four pre-election campaign statements, in violation of Government Code Sections 84103, 84200, 84200.5. (13 counts). Additionally, the Adelanto Committee, Daniel Ramos, and Arsineda failed to establish, maintain, and utilize a campaign bank account, in violation of Government Code Section 85201 (1 count). Total Proposed Penalty: $57,500.

Letter to City Council Regarding
HDCM, Inc. Dispensary & Negotiations

Dear Mayor Gabriel Reyes, Mayor Pro Tem Daniel Ramos, Councilwoman Joy Jeanette, Councilwoman Amanda Uptergrove, Councilman Angelo Meza

In 2017, Tim and Diana as their company HDCM applied for a cannabis dispensary license. During the licensing process, HDCM’s application was “lost” and was not viewed by the Dispensary Committee. Every time HDCM came forward in public meetings to resolve the issue, we were suppressed. Through the years, evidence was gathered. The FBI discovered the licensing process had been tainted with bribes and kickbacks. In August 2023, former Mayor Rich Kerr was convicted of bribery and kickback schemes related to cannabis dispensary licensing. This situation has been scrutinized by the FBI, and the federal courts found him guilty. Former Mayor Kerr is currently serving 14 months in federal prison.

After Kerr’s conviction, Tim and I as our corporation HDCM retained legal counsel and filed an administrative complaint with the city. That document went to a company called “Carl & Weiss”. An employee of Carl & Weiss named Alyssa conducted an investigation into the matter. During this meeting between Alyssa and HDCM’s attorney a dispensary license was offered without acknowledging the financial harm Kerr’s schemes caused. Who authorized Alyssa from Carl & Weiss to offer a dispensary license to our attorney?

During this time, our attorney had staffing issues and had to resign from our case.

Through legal consultation, we have discovered that a partial settlement should be awarded to HDCM, so that the City and HDCM can negotiate the terms that are outlined in the Administrative Complaint.

Tim and Diana as HDCM attempted numerous times to reach City Manager Jessie Flores, City Clerk Brenda Lopez, and Administrative Assistant Virginia via phone and email in an attempt to resolve the issue before HDCM retains another lawyer. We never received a call or email back. Tim sent an email to City Clerk Brenda Lopez requesting that it be forwarded to City Attorney Todd Litfin. Mr. Litfin forwarded the issue to City Cannabis Attorney Marc Tran. After many days, a zoom meeting was organized.

On April 4, 2024 Tim and Diana attended a zoom meeting with City Cannabis Attorneys Marc Tran and Al Mr. Al Ford. During this meeting it was discovered that Mr. Tran had no knowledge of the negotiations that had taken place with Carl & Weiss and our previous attorney. We informed both attorneys Tran and Ford that we had been offered a dispensary license and we would like to negotiate the rest of the terms in the demand letter before we retain our new attorney for litigation. Both Tran and Ford could not believe that we had been offered a dispensary license from Carl & Weiss Principals. Tran and Ford verbally requested the documents to support the offer from Carl & Weiss. That was the end of the meeting. Within an hour Tim and Diana provided documentation that confirmed the dispensary offer. Mr. Tran asked for further information via email. Diana answered in a timely manner.

Six days after the zoom meeting, we reached out to Mr. Tran via email to receive an update. Mr. Tran replied with a curt email that he was still investigating the “alleged” situation, and that he does not have the authority to sign off on any extensions (tolling) to negotiations. This is contrary to the statements made by Mr. Al Ford during the brief zoom meeting asserting that he and Mr. Tran are authorized to negotiate with the full power of the City of Adelanto.

HDCM has always maintained that we would rather negotiate instead of initiate litigation. We can’t get past the inner chaos of this city to organize a favorable outcome for the city and HDCM.

We respectfully ask our City Council Members to urgently take action to resolve this issue in a way that is positive, productive, and cost effective for the residents of Adelanto. Our deadline to communicate and resolve this issue is Sunday, April 14, 2024. Monday April 15, 2024 we will have no other recourse but to file the lawsuit.
