香港兒童權利委員會 Hong Kong Committee on Children's Rights Against Child Abuse saw the need to address the serious problem of children left unattended while their parents are working or involved in other activities.

A Bit of Our History

在二十世紀八十年代後期,香港經歷了大家庭的衰落,而除著經濟基礎的變化,愈來愈多家庭發現雙重薪金或收入是唯一生存的辦法。防止虐待兒童會意識到我們有需要應付當兒童的父母在外工作或從事其他活動時,兒童被獨留在家無人照料的嚴重問題。為此,一個關注小組亦聯同社會上各界的專業人士成立了。另一方面,小組的成員開始察覺到我們的兒童要面對的問題是複雜和多面的,所以我們需要一個策略性及全面的計劃。

在1992年,這個關注小組重新命名為香港兒童權利委員會(隸屬於防止虐待兒童會之下)。委員會的最主要目標就是把聯合國《兒童權利公約》延伸到整個香港。聯同防止虐待兒童會,我們舉辦了一系列以宣揚兒童權益為目標的活動。在1994年九月《兒童權利公約》延伸到香港,我們的工作亦有了新的方向。

由1995年12月28日起,香港兒童權利委員會正式成為一個獨立機構。現在

本會的運作地點就是在香港西區的一個古蹟建築物的頂層,我們同時亦是童夢同想的秘書處。童夢同想是香港首個兒童主導的組織,目標是以兒童的力量推動兒童權利。我們亦會和防止虐待兒童會一起為童夢同想提供各方面的支持,協助它成長。

The late 1980s of Hong Kong witnessed the withering away of the extended family, and with the changing of the economic fundamentals, more and more families find that a double payroll is the only means to survive. As a result a concern group was set up with other professionals in the community. On the other hand, there was also a growing awareness among its members that the problems confronting our children are of a complex and multi-dimensional nature; and, therefore, a strategic and comprehensive plan is required. In 1992 the group renamed itself as the Hong Kong Committee on Children's Rights (under the auspices of Against Child Abuse). A major goal then was to lobby for extension of the United Nations Convention on the Rights of the Child to the territory. In conjunction with Against Child Abuse, the Committee organized a series of activities aiming to promote the concept of children's rights. With the extension of the Convention to Hong Kong in September 1994, the work of the Committee took on a new dimension. With effect from 28th December 1995, the Hong Kong Committee on children's Rights is officially an independent organization. Now the Committee operates in an independent address under the roof of a charming heritage building in the Western District of Hong Kong, we also serve as the secretariat office of Kids' Dream - Hong Kong's first child-led organization that focused on promoting children's rights with children's efforts. Together with Against Child Abuse, we provide secretarial and mentorship support to Kids' Dream to help it grow.

🌘「我的世界,只剩下黑白色的光影在晃動;耳邊,是近乎無聲的寂靜。我是浩良,一名視聽障跑手。」
透過跑步,浩良在黑暗與寂靜中學會了與恐懼相處。每一次呼吸,都在克服內心對未知的害怕。跑步讓他重新找回對生命的掌控感。
而在這條漫長的跑道上,浩良並不孤單。領跑員 Donald成了他的眼和耳,一起經歷過無數公里的訓練,共同征服過全馬與 100 公里的超馬。透過那條細細的領跑繩,他們分享著呼吸、節奏,還有在艱難時刻互相支撐的默契。
「現在,我和 Donald 決定趁著我身體狀況還能支撐前,去完成那個早前訂下的夢想:挑戰 7 天完成 250 公里的蒙古 戈壁沙漠馬拉松! 」

🌘 “In my world, only black-and-white shadows flicker; in my ears, there is a near-silent stillness. I am Ho-leung, a runner with visual and hearing impairments.”
Through running, Ho-leung has learned to live with fear amidst the darkness and silence. With every breath, he overcomes his inner fear of the unknown. Running has allowed him to regain a sense of control over his life.
Yet on this long journey, Ho-leung is not alone. His guide runner, Donald, has become his eyes and ears. Together, they have trained through countless kilometers and conquered both full marathons and 100-kilometer ultra-marathons. Through that thin guide rope, they share their breath, their rhythm, and the unspoken understanding that supports them through the toughest moments.
“Now, Donald and I have decided to fulfill the dream we set long ago while my physical condition still allows it: to take on the 250-kilometer Gobi Desert Marathon in Mongolia in seven days!”

父母的選擇不應凌駕於兒童的權利之上📜

香港兒童權利委員會對媒體報導一名兩個月大嬰兒Danny一事深表關注,據悉其父母以私隱為由,至今仍未為該嬰兒辦理出生登記。

《兒童權利公約》訂明:「每名兒童應在出生後立即登記,並有自出生起獲得姓名的權利及取得國籍的權利」(第七條)。這些權利對於確保每名兒童都能被視為獨立個體,並享有包括醫療、教育及社會福利在內的所有其他權利,至關重要。

該《公約》條文亦反映在《香港人權法案》第20條,當局必須予以保障。若未能履行此責任,恐將導致兒童落入監管盲點,使其面臨遭販運的風險。

《出生及死亡登記條例》(第174章)第7條規定,新生嬰兒的父母須在嬰兒出生後42天內,向出生登記處為該嬰兒辦理出生登記。違者最高可處罰款2,000港元或監禁六個月。

雖然在家分娩對父母而言可能是一種選擇,但新生兒的健康與福祉應是首要考量。若以不當方式剪斷臍帶,可能會對新生兒的健康造成明顯的傷害及後遺症。此外,無論是在公立或私立醫院出生,香港的新生兒在出生後立即會接種兩種常規疫苗:卡介苗(BCG,用於預防結核病)以及第一劑乙型肝炎疫苗。若未進行產前及產後檢查,亦會對嬰兒和母親的健康構成風險。

醫院也是出生登記程序中至關重要的一環。嬰兒出生後,接生的醫院或註冊助產士會填寫一份出生報告,其中包含所有分娩及嬰兒的詳細資料,例如新生兒的腳印,以利後續的出生登記程序。

此次各部門迅速且果斷的聯合行動,值得公眾鼓掌。這充分展現了父母的選擇不應凌駕於兒童的權利之上。

👶🏻 Every child has the right to life, medical care, and birth registration. Parents' choices should not take precedence over children's rights📜

The Hong Kong Committee on Children’s Rights (HKCCR) is deeply concerned about the media reports of a two-month-old baby Danny whose parents have failed to complete the baby’s birth registration on the ground of privacy reasons.

Convention on the Rights of the Child (CRC) states that “every child shall be registered immediately after birth and shall have the right from birth to have a name, the right to acquire a nationality” (article 7). These rights are essential to ensure that each child is recognized as a person and has access to all other rights including medical treatment, education and welfare benefits.

This Convention article is enshrined in Article 20 of the Hong Kong Bill of Rights and must be protected by the authorities. Failure to do so risks children falling under the radar and putting them at risk of child trafficking.

Section 7 of the Births and Deaths Registration Ordinance (Chapter 174) requires parents of a newborn to apply for the birth registration of the child at a birth registry within a period of 42 days after the day of such birth. Offenders are liable to a maximum penalty of a fine of HK$2,000 fine or up to six months' imprisonment.

While home birth might be a free option for parents, the health and well-being of the newborn should be the paramount concern. Cutting the umbilical cord in an improper way could bring distinct health disadvantages for the newborn. Besides, newborns in Hong Kong receive two routine vaccines immediately after birth: the Bacillus Calmette-Guérin (BCG) vaccine (for tuberculosis protection) and the first dose of the Hepatitis B vaccine, no matter if they are born in public or private hospitals. Failing to have pre-natal and post-natal check-ups also pose health risks to both the baby and the mom.

Hospitals also serve as the vital first step in the birth registration process. Upon a baby's birth, the attending hospital or registered midwife will compile a birth return containing all delivery and infant details, such as the newborn’s footprints, to facilitate the birth registration process.

The swift and determined cross-departmental actions this time deserve a public applause. It is a showcase that parents' choices should not take precedence over children's rights.
