IMMIGRATION LAW BASICS: Know the Difference
Many South Africans are angry, and understandably so. But anger without knowledge leads to chaos and arrests.
Let’s start with FACTS.
ASYLUM SEEKER
• A person who has applied for protection in South Africa
• Must report regularly to Home Affairs
• May be allowed to work or study temporarily under strict conditions
• Status can be withdrawn if abused
REFUGEE
• A person whose asylum claim has been APPROVED
• Has legal protection under SA and international law
• May work and study lawfully
• Can lose status if they commit serious crimes
ILLEGAL FOREIGNER
• A person with no valid permit
• Or whose permit has expired and not renewed
• Subject to arrest, detention, and deportation under the law
IMPORTANT:
Citizenship determines RIGHTS.
Criminality determines CONSEQUENCES.
Taking the law into your own hands is illegal and will destroy South Africans further.
