During the Eviction Court Watch Orientation, STUN organizer Jai Byrd laid out the appalling amount of time Springfield's Right to Counsel ordinance, or the evidence-based legislation that guarantees legal representation (a lawyer) for all tenants facing eviction, has been stalled by City Council’s Community Involvement Committee. We now know that an additional CIC meeting was canceled, making the updated count 10 out of 18 total meetings that didn't happen.

With the wait for this life-saving bill to be heard being three times longer than the average legislative process and committee chair Callie Carroll blatantly refusing to take an active role in understanding our city’s eviction crisis, it’s clear that certain legislators are intent on never allowing RTC to see a vote. We’re not having it; Springfield tenants deserve a fair and balanced court system, and our union won’t stand for anything less.

We’re sick and tired of legislators attacking the will of the people, and it will require all of us to win. That’s why we’re joining PROMO Missouri and People Not Politicians MO for their door knocking shifts through October and November for Amendment 3 and Proposition A.

Councilman Brandon Jenson, the sponsor of Right to Counsel currently in committee, joined us for Court Watch to see exactly how our justice system functions without an equal playing field when it comes to eviction proceedings.

The rude awakening he found is that even when judges want to provide a fair shake to tenants, the status quo keeps renters from accessing a lawyer.

When both tenants and landlords are represented in eviction court, judges are able to uncover the full story and arrive at just and accurate outcomes for all parties.

Thank you, Councilman Jenson, for continuing your efforts to move Right to Counsel to a vote. It’s time to balance the scales.

A balanced court system should be a given, but under the current eviction crisis tenants are not guaranteed legal representation. Meanwhile, the vast majority of landlords and property management companies are required to obtain a lawyer, which they can afford to pay with OUR rent. That ain’t right!

The results are catastrophic for individual households and our community at large. As it stands, Springfield spends between $30,000 to $50,000 for each SINGLE case of homelessness. With eviction as a leading cause to homelessness and children making up 40% of the impacted population, this isn’t an issue we can wait any longer to resolve.

Your family deserves stability and safety NOW, and yet Right to Counsel, which guarantees lawyers to tenants facing eviction, has been stalled in committee for over a year and a half. We must hold our elected officials accountable to US: the people they’ve sworn to serve.

From May to the beginning of September, our Court Watch Team has observed over 150 eviction court cases to better understand Springfield’s eviction crisis and the imbalance of the legal system that leads to housing instability in our city.

While we previously showed which City Council members accepted or rejected our invitations to court watch, only three followed through on attending with us over the past few months: Zone 3 Councilman Brandon Jenson, Zone 1 Councilwoman Monica Horton, and Zone 4 Councilman Bruce Adib-Yazdi.

It’s important that we also highlight both Councilmen Jenson and Hosmer, who attended last month’s Our Rights, Our Homes, Our Future town hall, and have both expressed strong support for Right to Counsel, the evidence-based legislation that prevents homelessness and guarantees tenants facing eviction a fair chance in court. The proposed RTC ordinance has been stalled in the Community Involvement Committee chaired by Councilwoman Callie Carroll for over a year and a half.

We are grateful for the insightful and nuanced conversations we had last weekend during the Our Rights, Our Homes, Our Future town hall. It was nothing short of empowering to hear from our incredible expert panelists John Po***ck, Paula Green, Emily Fessler, and Elle Fabro as they addressed attendees’ questions and delved into exactly what Right to Counsel would mean for Springfield.

Seeing all of our neighbors in one room was truly something moving, and we know our campaign for a Right to Counsel, or legislation that balances the scales of justice in our eviction court system, is what our community needs right now.

We extend a special thank you to Zone 3 Councilman Brandon Jenson and General Seat B Councilman Craig Hosmer for attending the town hall, taking an active role in the discussion, and expressing strong support for Right to Counsel.

For too long, our eviction court systems have been skewed in favor of landlords and property management companies who have been afforded legal representation. When both tenants and landlords are on equal footing in eviction court with Right to Counsel programs, judges are able to uncover the full story and arrive at more just and accurate outcomes for all parties.

Springfield, it’s time to bring balance to our community, and we can achieve this fairness when we come together.
