New South Carolina Law Cracks Down on Nitrous Oxide Sales to Minors
Governor Henry McMaster has signed important legislation aimed at protecting young people from the recreational misuse of nitrous oxide, also known as laughing gas or whippets. The new law, which took effect on May 18, 2026, prohibits the sale of nitrous oxide and nitrous oxide products to anyone under the age of 18. ๏ฟผ
South Carolinaโs Nitrous Oxide Regulation bill (S. 751) passed unanimously in both the House and Senate. It gives the South Carolina Law Enforcement Division (SLED) authority to conduct inspections and enforce the regulations.
The goal is to reduce access to the substance when used improperly for its intoxicating effects, while still allowing legitimate uses in medical, dental, automotive, commercial, and industrial settings. ๏ฟผ
What the Law Requires:
โข Retailers must verify age with valid identification before selling nitrous oxide or related products.
โข Sales of flavored nitrous oxide are now banned.
โข It is illegal to market or represent nitrous oxide for recreational inhalation or personal use.
โข To***co retail establishments (whose primary business is selling to***co products) are prohibited from selling nitrous oxide altogether. ๏ฟผ
Violators face misdemeanor charges with significant penalties:
โข First offense: Fine up to $1,000 or up to 6 months in jail, or both.
โข Second offense: Fine up to $5,000 or up to 1 year in jail, or both.
โข Subsequent offenses: Fines up to $10,000 or up to 3 years in prison, or both.
Businesses found in violation may also face administrative actions, including suspension or revocation of licenses and permits. ๏ฟผ
Nitrous oxide has valid applications in healthcare and industry, but its growing misuse as a recreational drug has raised concerns across the state.
