US Senate introduces bipartisan bill to streamline the ESA delisting process

Sens. Adam Schiff, a Democrat from California, and Pete Ricketts, a Republican from Nebraska, introduced the Improving Species Recovery Act, which would change how the Endangered Species Act handles recovery and delisting. The bill would establish measurable conservation milestones, standardized demographic metrics and a baseline for species when they are listed.

The goal is to create a clearer roadmap for recovery. Instead of debating whether a species has recovered, agencies would establish benchmarks and measure progress toward them. Meeting those milestones could also allow greater regulatory flexibility for states, agencies and private landowners. The sponsors say clearer benchmarks could reduce litigation over delisting decisions.

That could be significant for controversial species like wolves and grizzly bears, where the definition of “recovered” is often debated. The bill wouldn’t prevent lawsuits, but it could give federal agencies a much more clearly defined scientific and legal record to defend a delisting decision in court.
