We’re putting the final touches on what’s shaping up to be an incredible conference in Savannah—this is one you won’t want to miss. At the same time, we’re actively working to revamp our organization to make it more engaging, responsive, and member-focused.

A federal judge has sanctioned the Georgia Department of Corrections for destroying critical video evidence. The court found that the department failed to preserve footage of an incident despite being notified of its importance, allowing it to be overwritten. The judge determined this constituted bad faith and ruled that a jury will be instructed to assume the missing video contained evidence unfavorable to the defense.

The case underscores the critical importance of a robust records management program, particularly when it comes to legal and evidentiary holds. This incident highlights how inadequate records management practices can directly impact the outcome of legal proceedings. Without proper safeguards and adherence to established retention and hold policies, organizations risk losing key evidence, facing judicial penalties, and undermining their legal position.
