Resident-to-resident aggression (RRA) incidents include physical, verbal, and sexual abuse and are likely to cause emotional and/or physical harm. However, not all incidents are considered “abuse,” meaning the resident involved did not willfully harm the other resident. Every nursing home resident has the legal right to be free from abuse, neglect, exploitation, and misappropriation of property.

Under federal law, this includes freedom from:
-Corporal punishment
-Involuntary seclusion
-Any physical or chemical restraint not required to treat a medical condition
-Verbal, sexual, physical, and mental abuse

These are not suggestions, they are federally protected rights, and it's crucial that residents know them in order to demand them.

In Maryland, Governor Wes Moore has signed two critical bills passed by the Maryland General Assembly to strengthen oversight and protect residents in assisted living and nursing homes.

The first bill, establishes a permanent $2 million annual appropriation for Maryland’s Office of the State Long-Term Care Ombudsman. The funding will support investigations of complaints, expand advocacy services, and ensure stronger oversight of long-term care facilities.

This tip sheet emphasizes that representatives should prioritize personal safety and risk awareness when visiting facilities by preparing in advance, staying alert during visits, and following up afterward. Before a visit, representatives are encouraged to plan ahead by informing others of their whereabouts and considering potential risks; during the visit, they should remain aware of surroundings, trust their instincts, maintain professional boundaries, and avoid unsafe situations; and after the visit, they should document concerns and report any safety issues.
