The Union and NARA have entered into a settlement agreement to resolve the October 24, 2023 grievance filed by the Union regarding the NARA's change in telework policy.

To recap, in October 2023, NARA issued a new telework policy that led to a reduction in telework for employees who had previously been working from home more than six days per pay period. The union filed a grievance arguing that the existing agreements between the agency and the union did not give the agency the authority to institute a uniform agency-wide telework cap and that instead the agency had to determine the appropriate amount of telework available on an office-by-office basis. The grievance was not resolved, and the union invoked binding arbitration.

Instead of resolving the grievance through an arbitration hearing, the parties have voluntarily entered into a settlement agreement. The grievance settlement agreement addresses the matters raised in the grievance by requiring the agency to:

- Assess the business needs and the effectiveness of telework in a number of different NARA offices that were impacted by the policy change

- Upon completion of the assessment, engage in good faith bargaining with the Union regarding the possibility of changing the amount of telework available to bargaining unit employees in those offices

In exchange for this, the union withdraws its grievance and invocation of arbitration.

On Friday, October 6th, NARA management transmitted a message notifying employees of a change in policy related to telework that will take effect for employees in the bargaining unit in December of this year.

AFGE has assessed that this change establishes conditions that are not consistent with the Mid-Term Memorandum of Understanding that is an addendum to the 2019 Collective Bargaining Agreement. As such, the union will be undertaking enforcement action to remedy what we consider to be a violation of the CBA and, if implemented, an unfair labor practice in violation of Title VII of the Civil Service Reform Act of 1978. We are in the midst of determining the most suitable litigation strategy. The AFGE-NARA telework agreement is a major achievement, and we intend to defend it.

We will be discussing this at the October general membership meeting of Local 2578 on Tuesday, October 31st.
