Yesterday, the Federation for American Immigration Reform (FAIR) filed a brief in the U.S. Court of Appeals for the First Circuit urging the court to vacate an injunction issued by the U.S. District Court for the District of Rhode Island against tough vetting procedures and exclusions the Trump Administration has put in place for aliens, especially those from countries that do not keep reliable records. The plaintiffs challenge the policies under the Administrative Procedure Act (APA), claiming they are contrary to law and “arbitrary and capricious.”
