Stefan’s story is a common one. Born and raised in Cape May, NJ he wants his daughter to be able to take over the family fishing business. Even though she loves fishing, arbitrary regulations created by unaccountable bureaucrats may keep her from making that choice.

How much would you pay a bureaucrat to watch you do your job? That’s a question fishermen like Bill Bright have had to answer. The issue began when the government ran out of money to pay for at-sea monitoring. Instead of asking Congress for more money, regulators decided instead that herring fishermen would now pay for the third-party monitors. These monitors get more than $700 per day, which can be more than a ship’s captain or crew makes. Total costs for monitoring could reduce the fishermen’s annual take-home pay by 20%.

The fishermen sued but, as The Washington Times explained, they “lost in a 2-1 decision before a federal appeals court, where the majority said that under the 1984 Supreme Court ruling Chevron v. Natural Resources Defense Council, judges must give substantial deference to how an agency interprets a law.”

The Supreme Court’s Chevron doctrine has resulted in an incredible expansion of the powers of the administrative state over the past forty years. But next week the Supreme Court will revisit Chevron deference as part of the fishermen’s case.

A group of New Jersey herring fishermen today filed opening arguments asking the Supreme Court to strike down an unlawful federal regulation that could force them to surrender 20 percent of their earnings to pay for at-sea monitors.

“It’s humbling that a few herring fishermen like us could bring such an important case to the nation’s highest court,” said Stefan Axelsson, one of the fishermen who brought the case. “If the government can do this to fishermen trying to make an honest living, they can do it to anyone.”

Overruling Chevron would restore justice and constitutional checks and balances among the three branches of government.
