Two weeks ago, our team lost at trial in our class-action lawsuit challenging pretrial fees in Ravalli County, Montana. What began as a lawsuit with a handful of named plaintiffs in August 2021 evolved into something bigger than our individual plaintiffs, bigger than Equal Justice Under Law, and bigger than Ravalli County. Over the course of nearly five years, we uncovered thousands of documents and records, hundreds of affected class members, dozens of devastating stories, and hundreds of thousands of dollars collected by the Ravalli County Sheriff's Office on the backs of the community’s poorest and most vulnerable citizens.

A loss in court does not erase what this case uncovered, and it does not diminish what this case meant to our clients. Their stories made it into a courtroom, and our team gave thousands of hours of work to make sure our clients were heard. The work we do to end wealth-based discrimination in the criminal justice system is bigger than any single verdict, including this one.

Each Complaint we file, each motion we argue, and each story we tell is itself a win. We lost this one, but we are not defeated, and we are more proud than ever to stand with our clients.

In the class action case, plaintiffs allege a pretrial supervision program run by the Sheriff’s Office in Ravalli County is charging “outrageous” fees to people least able to pay them, and it is doing so without due process.

UPDATE: Next week, our team at Equal Justice Under Law is going to trial in Montana’s federal court. We’re suing Ravalli County for charging pretrial supervision fees to indigent arrestees just for them to stay out of jail before they go to trial.

After more than four years of litigation, we seek to put an end to this wealth-based incarceration and to hold Ravalli County accountable for violating due process.

This upcoming trial brings us one step closer to ending Ravalli County’s pay-or-jail scheme not just for our plaintiffs, but for all people.

Over the past two weeks, our most recent lawsuit challenging Georgia’s foster care fees scheme has gained national attention.

Both The Atlanta Journal-Constitution and the Associated Press covered the case, and the Associated Press coverage was subsequently picked up by ABC News, WJCL News, WTOP News, and many more outlets nationwide.

NEW: Today, Equal Justice Under Law filed a federal class-action lawsuit in the Northern District of Georgia challenging the state’s unconstitutional foster care fees scheme that charges exorbitant and arbitrary fees to parents living in poverty whose children are in foster care. The lawsuit alleges that Georgia’s Division of Family and Children Services (DFCS) removed children from more than 700 families between 2018 and 2022 solely for reasons of poverty, and then turned around and charged parents of those same families unaffordable monthly child support amounts.

Phil Telfeyan, Executive Director of Equal Justice Under Law, states, “Georgia will seize your children because you are too poor to afford housing, but the state will then add insult to injury by billing you into deeper poverty. These irrational and counterproductive charges are uncollectible — they only serve to delay reunification of children with their parents.”

We are committed to ending this discriminatory and unconstitutional system in Georgia and ultimately, across the country. Parents should never be separated from their children for reasons of poverty and they especially should not be charged hundreds or thousands of dollars monthly in fees that defy all principles of logic, fairness, and equal justice. The American legal system promises to treat all people the same, regardless of wealth. In places like Georgia, where we see the legal system targeting and punishing people for their poverty, we have no choice but to intervene.
