> Subject: Request for Pause on 2027 UCR Fee Hike Rulemaking
>
> Dear Administrator Barrs,
>
> Under separate cover, the SBTC has advised Larry Minor SBTC is considering seeking a stay on the 2027 UCR fee hike rulemaking (now that the case will not undergo expedited merits review but has survived the government's motion for summary disposition).
>
> To be clear, such a stay would not affect the agency's existing 2024 fee rule so it would not adversely affect the states' ability to continue to receive safety funding from industry in 2027 at 2024 fee levels. We just feel raising the fees while this case is pending is inappropriate.
>
> We are planning on filing a formal more detailed comment to the docket and encouraging SBTC members, partners, and followers to file their own comment, asking for the agency to please press pause on a fee hike for 2027 UCR while the legality of the UCR System Plan & Agreement is adjudicated by the US Court of Appeals for the DC Circuit.
>
> We believe this is a reasonable and prudent request that we would like to immediately put in front of the agency. A copy of this email is being uploaded to the rulemaking docket and posted on social media.
>
> Please advise if the agency is willing to do this voluntarily before the end of the 2027 UCR Fee Rulemaking comment period so we may know if we can avoid expending judicial resources on this request through a formal motion for stay, which we are confident the Court would approve.
>
> Thank you for your consideration.
