A4TE has filed a class-action lawsuit against Aetna on behalf of three transgender women and others like them who were denied coverage for medically necessary gender-affirming facial reconstruction procedures: https://buff.ly/47taWO8

Gender-affirming facial surgeries are essential medical treatments for gender dysphoria, a serious medical condition that arises from the incongruence between a person's gender identity and their physical s*x characteristics.

As A4TE's Co-Interim Legal Director Gabriel Arkles stated, "Aetna’s refusal to cover gender-affirming healthcare, despite the medical necessity, forces trans women and nonbinary people into a position where they must continue to suffer or, if they can, take on the financial burden of paying for their healthcare out of pocket."

With many Republican politicians focusing efforts on passing anti-trans policies rather than policies that help their constituents, trans people and their families, friends, and loved ones are prepared to turn up this election to stop them. As A4TE’s Rodrigo Heng-Lehtinen stated:

“LGBT people are seeing that there is one party who is treating us like decent human beings, and there is another party who is putting a target on our backs, and that is highly motivating... Transgender people, we know our lives are on the line. We know we’re in the political crosshairs, so we’re motivated to turn out.

Our recently released US Trans Survey Civic Engagement report showed that 75% of voting-eligible respondents cast a ballot that year, compared with 67% nationwide. On August 13, we hosted a “Trans Folks for Harris” fundraising call with trans elected officials and advocates from across the country.

On August 16, more than two weeks after the Biden administration passed a rule expanding Title IX s*x discrimination protections to include s*xual orientation and gender, the U.S. Supreme Court rejected the Justice Department’s request to limit injunctions against the rule to allow its application during litigation. The 5-4 ruling in favor of continuing to block the rule affects 26 states and hundreds of schools in other states. The August 16 ruling is effectively an order from five justices allowing anti-transgender arguments to block an entire multifaceted federal rule. Almost all of the challenges only addressed three provisions of the more than 400 page rule aimed at providing additional protections for transgender students.

The first appellate argument is scheduled for October on the Justice Department’s appeal of one of the preliminary injunctions. The August 16 order is powered by the anti-trans politics of the day, but A4TE and our allies will continue to fight to protect equality, justice, and equity for all transgender people under Title IX.

Anti-trans politics powered the challenges, but the federal judiciary did this — from the conservative high court to far-right lower court judges empowered to act out.

The National Center for Transgender Equality Action Fund is proud to announce its endorsement of President Joe Biden for a second term. Since taking office, President Biden has surpassed the efforts of all preceding administrations in his dedication to advancing the protections & rights of the transgender community. Without question, the Biden Administration has been the strongest advocate for the needs of transgender Americans of any presidential administration in American history.

Throughout his first term, President Biden has laid the groundwork for a new era of strengthened rights and improved well-being for transgender Americans. We anticipate and look forward to further momentum for the advancement of transgender rights that could be accomplished in a second term, and toward a future where collaborative initiatives continue to thrive. The pursuit of equality remains an ongoing journey, and the Biden Administration’s accomplishments of today lay a solid groundwork for an even more promising tomorrow.

The Human Rights Campaign, the National Center for Transgender Equality, and Equality PAC, some of the nation’s leading LGBTQ organizations, endorsed Biden on Tuesday
