Forced arbitration re-victimizes sexual assault survivors by denying a public trial and coercing them into silence. Meanwhile, abusers are emboldened to operate with impunity. Ending forced arbitration of sexual assault claims will allow survivors to speak openly and will protect others in workplaces across the country.

Yesterday, we heard from four women at the House Committee of the Judiciary hearing. Eliza Dushku, Tatiana Spottiswoode, Andowah Newton, and Lora Henry shared their stories of the fear and harm inflicted upon them by their employers. Forced arbitration clauses restrict Americans’ access to justice by stripping workers of their right to go to court. These clauses, which are often buried in the fine print of employment contracts, shuttle victims of workplace sexual violence, harassment, and discrimination into private arbitrations, where the arbitrator, the law, and the rules applied are often chosen by the company. These proceedings are conducted in secret, without public rulings and with no judicial review.

FACT: At least 1 in 4 women experience sexual harassment in the workplace. Forced arbitration silences those who speak out and allows for toxic office cultures to flourish. Survivors of sexual harassment and sexual assault should not have to suffer in silence. It is time to .

Today, Tuesday, November 16th at 10:00AM ET, the will hold a hearing examining how forced arbitration clauses are used to wrongly prevent survivors of sexual harassment and sexual violence from seeking justice in a public court of law, tune in: https://youtu.be/JC5y1GbfUVk

The mission at TIME’S UP—safe, fair, dignified, equitable work for ALL women—relies on the foundation of caregiving support. Caregiving is a gender, economic, and racial justice issue. When women are forced to reduce their hours, or forced out of the job market altogether due to increased care needs, the economy suffers.

As the COVID-19 crisis continues to evolve, leaders must ensure that changes to daily operations do not unintentionally roll back work culture or exclude women, people of color, LGBTQIA+, people with disabilities, older workers, people with caregiving responsibilities, and other vulnerable employees from career advancement.

As the holiday season approaches, we often hear, “I’m afraid to ask to take my vacation time,” “I’m afraid to return to a pile of work after taking time off,” “ I’m afraid I won’t look dedicated enough if I go on vacation,” or even “I’m afraid I’ll get fired.”

You’re not alone.

In a culture that places huge value on working hard and doesn’t recognize the importance of time off, it’s not unusual to have fears about claiming your time for rest.

Taking time off is important. A few days or weeks away from work can help you gain perspective on your life, clear your head, support your mental health, and increase productivity.
The good news: peer counselors are just a text away. Text 510-674-1414 or start a web chat: https://www.empowerwork.org/how-it-works.

Leaders can combat the “Great Resignation” by building more equitable workplaces. As companies are rethinking return-to-office plans, it’s vital to listen to the unique needs of all employees—and create new systems and programs that will benefit everyone, such as on-site child care, flexible schedules, paid leave, and employee assistance programs.
