Virginia voters are being asked to decide whether to place a fundamental right to abortion into the Virginia Constitution.

While proposed Constitutional Amendment Question 1 is being presented to voters as protecting “reproductive freedom,” the actual amendment goes much further than the language on the ballot suggests. It would establish abortion as a fundamental right, make existing protections for parental notice vulnerable to constitutional challenge, and significantly limit Virginia’s ability to protect unborn children, including during the third trimester.

Should a surrogacy contract be used to pressure a woman into obtaining an abortion that violates her conscience? The Preventing Forced Abortions Act of 2026 would ensure that the answer is no.

McKenna West recently gave birth after refusing the intended parents’ request that she obtain an abortion following a diagnosis that the child had a serious congenital heart condition. The intended parents are reportedly seeking more than $100,000 from West for alleged breach of the surrogacy agreement.

A right to refuse an abortion offers little protection if intended parents can accomplish the same objective through financial coercion. That is why this legislation is so important. At a time when surrogacy arrangements are becoming increasingly common, lawmakers should act to ensure that contracts cannot be weaponized against women who choose life.

Big Tech has had too much control over our kids for too long.

Meta’s new protections are a step in the right direction. Now it’s time for TikTok, YouTube, and the rest of Big Tech to put parents first.

A Maryland circuit court has now ruled that the Democrat super-majority which controls the Maryland legislature did not follow the law when drafting a proposed constitutional amendment.

If election safeguards can be written into law and then bypassed when they interfere with a political objective, those safeguards offer voters little protection. The rule of law requires something more. Government officials must follow the rules that govern elections. Voters must receive an accurate explanation when they are asked to change their Constitution.

Now, we’re seeing real progress. Meta has reached an agreement with 52 state and territorial attorneys general that will put meaningful new protections in place for teenagers on Facebook and Instagram.
At ACLJ Action, we support this settlement because it puts authority back where it belongs: with parents.
