🚨 A State Just Rebuked the Federal Government Over Nuclear Waste

New Mexico has formally called out the U.S. Department of Energy for failing to clean up decades-old radioactive waste at Los Alamos and is threatening up to $16 million in fines.

Here’s the bigger issue:
• Legacy nuclear waste remains buried in unlined pits
• Cleanup deadlines were missed
• Groundwater concerns persist
• Meanwhile, new waste production continues

This isn’t anti-nuclear energy.

It’s pro-accountability.

If the federal government cannot meet cleanup obligations at one of its most historic nuclear sites, why should states trust federal promises about future “temporary” storage projects?

Consent matters.
Cleanup comes first.
Accountability isn’t optional.

Nuclear energy has value — but nuclear waste demands rigor, independence, and public trust.

This week, Japan halted safety reviews at nuclear plants after discovering serious oversight issues. It’s a reminder that even advanced systems can fail without strict accountability.

The lesson is clear:
⚠️ Safety reviews must be credible
⚠️ Regulators must have clear authority
⚠️ Communities must not be bypassed

👉 Finland’s Onkalo facility is a deep geological repository designed to isolate waste for 100,000+ years safely. Built with community consent, backed by science, and already operational.

👉 In the U.S., the Nuclear Waste Policy Act promised a permanent solution in the 1980s. Billions were collected, Yucca Mountain stalled, and today we’re shipping waste around the country with no final plan.

📌 Lesson: Leadership means responsibility. The U.S. can’t call nuclear “clean energy” until we manage the waste responsibly.

🗣️ On paper: NRC says the public can participate through comments, hearings, and environmental reviews.
🚫 In practice: The Supreme Court has ruled that unless you’re an official party in the NRC licensing process, you can’t challenge licenses in court.

Translation: Submitting comments or voicing opposition isn’t enough to gain legal standing.

That’s not real consent. That’s a closed loop.

🚨 Breaking News: Holtec International has pulled the plug on its plan for high-level nuclear waste storage in New Mexico.

This outcome was driven by the power of the people — grassroots coalitions, local leaders, and New Mexico’s elected officials who worked diligently to pass laws of protection.

It’s proof that community opposition works. But the fight continues: Holtec has already said it will look for “amenable” states. We must remain vigilant and push for a permanent, safe, consent-based solution to America’s nuclear waste challenge.

What’s Problematic with “Interim Storage”

✋🏼 Delays & lack of permanent solution — If a permanent disposal site (like Yucca Mountain, or others) never materializes, interim storage sites may become permanent by default.

🚞 Transportation risks — Moving spent fuel from many reactor sites across the country increases accident, spill, or security risks.

⍯ Equity concerns — Rural or less powerful communities may disproportionately bear the risks. Often, they have less say in decision-making.

👨‍⚖️ Regulatory/legal loopholes — Licensing and oversight may allow interim sites to operate for decades without clear permanent plans. Some licenses are being challenged or revived in courts- such as the Interim Storage Partners project in Andrews County, New Mexico and the Holtec facility in Lea County, New Mexico.

What is Nuclear Waste?

Nuclear (radioactive) waste comes from nuclear reactors, medical uses, research, and weapons programs. The kind that worries most people is high-level waste, especially spent nuclear fuel from power plants. It generates heat, radiation, and remains dangerous for thousands of years.

🔹 Low-level waste: lightly radioactive materials (clothing, tools, filters). Easier to store and dispose of.
🔹 High-level waste / spent fuel: the big challenge. Needs cooling (in water pools) and is then often moved to dry cask storage. Eventually, a permanent disposal site deep underground is the ideal. But we don’t have that yet.

Knowing these differences helps us understand what policies and storage proposals really mean—and what risks they carry.

• More renewables + storage
• Advanced nuclear reactors
• Better energy efficiency and cooling systems
• Smarter grid management (including AI itself to optimize)

• Communities near power plants & storage often bear health & environmental risks.

• People with less wealth or political power often have less input.

• Energy bills hit low-income households hardest when costs rise.

Equity means wanting policies & regulations that ensure fairness in decision-making and protection.
