1) Criminal Prohibition of the deep Fake & Revenge p**n new laws: The law makes it a federal crime to knowingly publish or threaten to publish non-consensual intimate imagery using an interactive computer service, regardless of whether the content is authentic or AI-generated. Penalties include up to two years imprisonment for adult victims and up to three years for minors. The first conviction under the law came in April 2026!!!
2) In a lawsuit filed by City Attorney Chiu in CA who goes after 16 website owners and operators who he says violate state and federal laws prohibiting deepfake p**nography, revenge p**nography, and child p**nography. 10 of those sites are now gone!
3) Federal Law: TAKE IT DOWN Act
President Trump signed the TAKE IT DOWN Act (Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act) on May 19, 2025, following near-unanimous congressional support (409-2 in the House, unanimous in the Senate). The law represents the first major federal response to AI-generated intimate imagery.
4) The Senate unanimously passed a bill that would allow victims to sue the creators of nonconsensual sexually explicit deepfakes for a minimum of $150,000.
