(MD Housing and Community Development)
⚖️ 1. ANTECEDENTES PENALES: NUEVAS LIMITACIONES
(MD Housing and Community Development)
(MD Housing and Community Development)
(MD Housing and Community Development)
(MD Housing and Community Development)
(MD Housing and Community Development)

🇺🇸 LOOKING FOR HOUSING IN MARYLAND? NEW PROTECTIONS ARE NOW IN EFFECT
Beginning October 1, 2026, Maryland implemented new rules affecting renters, housing applicants, and housing providers. (MD Housing and Community Development)
⚖️ 1. CRIMINAL HISTORY: NEW LIMITS
The new Maryland Fair Chance Housing Act limits how certain landlords and housing providers may use an applicant’s criminal history.
The law generally applies to providers that own or manage 5 or more residential units in Maryland. (MD Housing and Community Development)
Among other protections:
• A housing provider generally must first make a conditional offer of housing before checking certain criminal history.
• If the offer is withdrawn because of criminal history, the provider must explain the reason.
• The applicant may request a reassessment and provide additional information.
• Providers may not advertise that applicants with criminal histories will not be considered.
• Prospective tenants may not be required to undergo drug or alcohol testing. (MD Housing and Community Development)
⚠️ The law does not mean that all criminal history is irrelevant. Certain convictions may still be considered under specific circumstances.
💵 2. IF YOU USE A HOUSING SUBSIDY
When an applicant uses an income-based housing subsidy, a housing provider generally may not refuse to rent solely because of:
• The applicant’s income
• Credit score or lack of a credit score
• Certain adverse credit history that occurred before the applicant had the subsidy
The provider may still verify that the applicant can pay the portion of rent not covered by the subsidy and may consider other reasonable, nondiscriminatory information. (MD Housing and Community Development)
📈 3. YOUR RENT MAY HELP BUILD CREDIT
Housing providers must offer tenants the option to have their complete and timely rent payments reported to consumer reporting agencies.
For new leases, the option must be offered beginning October 1, 2026.
For leases signed before that date, tenants must be offered the option by January 1, 2027. (MD Housing and Community Development)
A housing provider may charge a fee, but it may not exceed the actual cost of the service or $10 per month, whichever is less. (MD Housing and Community Development)
