Re: Amending S-11 Legislation to Remedy the Unconstitutional Effects To The Residents of Atlantic City

Dear Senator Whelan and Assemblymen Brown & Amadeo;

We are writing in

regard to the above captioned matter and to follow up on months of preparation and research as to the misapplication of S-11 and it’s unconstitutional effects of S-11 as it relates to the City of Atlantic City Residents. Pursuant to U.S.C. 1984 a law may not have a prejudicial effect even without intent. As you should be aware, S-11 and related legislation pertaining to the City, State and CRDA produce that discriminatory effect in taxing hard working men, women and seniors out of Atlantic City. The causation is that, while the CRDA “controls” the Toursim Zone, it pays nothing toward the public safety of that zone which is ½ the City. That burden falls on the residential taxpayer and is an inequitable burden. The CRDA & State MUST be required via legislation or Judicial order to pay it’s equitable share of the City Public Safety Budget. With that said, additional tax burden is shifted to the residential tax payer by the CRDA not being directed to pay one dime for any of the 600 lots it presently owns in the City. This must change as that burden is also shifted to the residential taxpayer. The promises of casino gaming have never been kept for the residents of Atlantic City. The State and the Region have done nothing but take. The State takes our luxury tax, our room tax, parking fees etc..and now our ability to control zoning and planning in the “Toursim Zone”. In an effort to move this issue forward to challenge the Constitutionality of this law we have collectively reached out for the NAACP and the ACLU to consider the necessary legal challenges. However we wanted to follow up with our petition efforts to seek to ameliorate these issues. We the residents of Atlantic City in an effort to form a more equitable tax structure and protect specific rights afforded to us by the United State Constitution have executed the attached petitions to ask that you take collective or individual legislative action to remedy these issues immediately and incorporate the appropriate legislative language attached hereto. LEGISLATIVE MADATE #1 TO S-11
THAT THE STATE OF NEW JERSEY THROUGH IT’S ADMINISTRATIVE AGENCY THE CASINO REDEVELOPMENT AUTHORITY, HEREINAFTER CRDA SHALL CONTRIBUTE AND PAY 50% OF THE CITY OF ATLANTIC CITYS’ PUBLIC SAFETY BUDGET AS IT IS HEREBY RECOGNIZED THAT ½ OF THE GEOGRAPHIC PARAMETERS OF THE CITY OF ATLANTIC ARE WITHIN THE STATE TOURSIM ZONE. LEGISLATIVE MANDATE #2 TO S-11
THAT THE STATE OF NEW JERSEY SHALL REQUIRE AND DIRECT IT’S ADMINISTRATIVE AGENCY TO PAY IT’S EQUITABLE SHARE OF PROPERTY TAXES FOR REAL ESTATE HOLDINGS IT OWNS IN THE CITY OF ATLANTIC CITY AS WELL AS ANY OTHER STATE AGENCY AND / OR EDUCATIONAL INSTITUTION. SUCH PAYMENT OF PROPERTY TAXES SHALL BE DEEMED EQUITABLE AND JUST AS TO THE FAIR MARKET VALUE OF THAT SUBJECT PROPERTY. We the signors of this subject matter petition fully support the aforementioned legislative changes as equitable and just as to providing the equitable tax relief for residents of Atlantic City and resolving the related Constitutional issues:
