SWATCAWU salutes Cde Noel Coard, ITF Director of Land Transport.

Comrade Noel is retiring today (July 31, 2026) from the ITF, and SWATCAWU General Secretary Cde Sticks Nkambule wrote to him in appreciation of his incredible service.

BREAKING NEWS: Sticks Nkambule & Others v Minister of Labour and Social Security, IC CASE 398/2022

The long-awaited ruling by the Industrial Court of Swaziland concerning the General Secretary (GS) Cde Sticks Nkambule was issued today.

The Court dismissed the application for the GS to appear virtually before it. This ruling had been anticipated since May 2025, but was only delivered 12 months later. Notably, upon delivery, the ruling still required correction of typographical errors, meaning the waiting continues. Justice delayed is justice denied.

SWATCAWU shall reflect on the matter once a written ruling is released, and the reasoning thereof is noted.

On Monday, (11-05-2026), the Supreme Court is scheduled to deliver its determination concerning a frivolous appeal filed by the Teaching Service Commission (TSC) against the SNAT President: Mbongwa Ernest Dlamini. The matter stems from the stacked deck termination of employment of the SNAT President, on August 29, 2023—an action previously characterized by the Courts as arbitrary and unfairly predicated on his performance of union-related duties. Despite three (3) successive judicial verdicts exonerating the President of any misconduct or malfeasance, the TSC, under the leadership of Amos Mahlalela, has consistently declined to reinstate him to his post at Moyeni High School. The legal history of the case includes a landmark ruling on August 1, 2025, in which High Court Judge Zonke Magagula dismissed the TSC’s application to review an earlier Industrial Court Judgement. In a stern ruling, Judge Magagula found Mr. Mahlalela in contempt of court, providing a seven-day window for him to purge himself or be sent to the gaol. Notwithstanding determinations by the Learned Judicial Officers of two (2) different Courts (Industrial and High Court), the TSC has chosen to dig in its heels, disregarding the rulings issued by the Justices. The upcoming Supreme Court session represents the latest development in this prolonged legal dispute with millions of taxpayers money used by Eswatini Government to fight a mere trade union Leader.
