Portugal Approves Major Changes to Nationality Law

The Portuguese Parliament has approved a major reform of the nationality law through Lei Orgânica n.º 1/2026, published on 18 May 2026.

The new legislation introduces stricter requirements for obtaining Portuguese citizenship and places greater emphasis on long-term residence, cultural integration, security checks, and economic self-sufficiency.

Key Changes
Residency requirements for naturalization have increased:
7 years for EU and CPLP citizens
10 years for citizens of other countries
Applicants must now demonstrate:
knowledge of Portuguese language, culture, history, and national symbols
understanding of citizens’ rights and duties
knowledge of Portugal’s political system
commitment to democratic constitutional principles
Stronger criminal and national security screening measures have been introduced.
New biometric data collection procedures, including fingerprints and facial data, will apply to nationality applications.
Children born in Portugal to foreign parents may obtain nationality if one parent has legally resided in Portugal for at least five years.
Foreign spouses and partners may still apply after three years of marriage or recognized union, subject to stricter review procedures.
Protection for Existing Citizens
The law also introduces a safeguard for individuals who have held Portuguese nationality in good faith for at least 10 years, protecting them from later cancellation except in cases involving fraud.

Transitional Rules
Applications already pending before the law enters into force will continue to be processed under the previous legal framework.

The law enters into force the day after its publication.
