This is a critical moment for the Southern Highlands.

UPDATE ON REPOLY CASE: CONCILIATION TERMINATED

The Land and Environment Court has today terminated the Section 34 conciliation process, which was commenced last November. The proceedings have been listed for a further telephone mention before the Registrar of the Court at 10.30am on Monday 11 May 2026 at which time it is likely that directions will be made concerning preparation for the hearing.

We’ll keep you posted, as well as provide some ‘explainers’ about court processes.

UNDERSTANDING THE LEC - THE COURT WHERE THE REPOLY CASE IS BEING HEARD:

The NSW Land and Environment Court (LEC) is a specialist, superior court that handles planning, environmental and mining law. It exists specifically to resolve disputes about how land is used and how development is assessed.

The IPC — the Independent Planning Commission — refused consent for the proposed plastics facility in the Southern Highlands in January 2025. We strongly supported that refusal and believe it was the right decision.

The proponent, Repoly Pty Ltd, has appealed against that refusal in the LEC. Southern Highlands Matters Inc. is the community respondent in those proceedings, represented by Chair Sam Wood as Second Respondent — a position we committed to from day one. We are in court to defend the outcome we fought for and to ensure the Court hears the full environmental and public interest case against this development.

The LEC will now consider Repoly’s development application on its merits – in effect, it stands in the shoes of the IPC. That’s why the quality of expert evidence, legal argument, and preparation matters so much. We’re here for all of it.

Conciliation Conference Further Adjourned — What You Need to Know

Today, 19 March 2026, the parties in the Land and Environment Court appeal involving Repoly’s proposed plastics recycling facility in Moss Vale resumed the compulsory conciliation conference under Section 34 of the Land and Environment Court Act 1979, which commenced on site last November.

The Second Respondent, Ms Sam Wood, instructed her lawyers at the conciliation conference on behalf of SHM and as the community representative in these proceedings.

The Court has directed that the conciliation conference be further adjourned until 16 April 2026.

We will share an update with the community as soon as we are able, following the further adjourned conciliation conference.

Tomorrow’s Conciliation Conference — What You Need to Know

As part of the Land and Environment Court proceedings against Repoly’s proposed plastics recycling facility, a compulsory conciliation conference under Section 34 of the Land and Environment Court Act is due to re-commence on Thursday 19 at 4.15pm in the Court.

Second Respondent Sam Wood will be attending on behalf of SHM and as the community representative in these proceedings.

This is a formal, closed court process. It is not open to the public and there is no public dial-in or gallery.

We will share an update with the community as soon as we are able following the conference.

The RePoly Proposal is for a large plastics reprocessing plant (previously known as Plasrefine) that was rejected by the Independent Planning Commission (IPC) in January 2025 after years of community opposition.

Now, the proposal is back with a Class 1 Merit Appeal lodged in the NSW Land and Environment Court, and they’re looking to overturn the IPC’s refusal.

This is the wrong facility in the wrong location. The site is too close to all our homes, farmland, vineyards, local schools, and wildlife.
