RePoly (formally PlasRefine) has appealed the NSW IPC’s decision to reject the plastic processing factory in the Southern Highlands.

As shared previously, with the Section 34 Conciliation Conference now concluded, the matter moves into the Joint Expert Report (JER) phase ahead of the October hearing.

This begins with conclave — expert witnesses from each party meeting directly, without lawyers present, to work through the technical aspects and evidence together.

As with the rest of this process, we’re limited in what we can share while conclaves are underway — but unlike the Section 34 Conciliation Conference, the resulting JERs are not confidential, and agreed findings can be formally tendered as evidence at the hearing.

We’ll share what we can, when we can, within the bounds the Court process allows.

Just 750 metres from the proposed RePoly plastics reprocessing facility is a childcare centre.

RePoly proposes to process up to 120,000 tonnes of plastic waste every year, operating in an area already surrounded by homes, farms and other sensitive land uses.

So we need to ask a very simple question:

Why would we put a large-scale plastics processing facility just 750 metres from a childcare centre?

What happens if there’s a major fire? What about smoke, airborne particles, truck movements and the cumulative impacts of a facility operating at this scale?

When it comes to our children, “probably safe” shouldn’t be the standard.

Heavy industry needs the right location. This isn’t it.

Residents of the Southern Highlands are being invited to give evidence when the legal battle over the proposed Moss Vale plastics recycling facility comes before the Land and Environment Court for the hearing in October.

A fire at a large plastics recycling facility isn’t an ordinary fire.

Burning plastics produces toxic smoke and hazardous contaminants, while firefighting water can become contaminated and needs to be contained — particularly when the site sits within the Sydney Drinking Water Catchment.

Families live nearby.
A childcare centre is close.
Farmland surrounds the area.
The Garvan Institute is next door.

This isn’t just an industrial fire risk.

It’s a risk to the Southern Highlands community.

This isn't hypothetical.
An ACT Government investigation into a major recycling facility fire found that the rapid spread and intensity of fires at facilities processing materials including plastics is “typical”, because these materials have a high heat release rate.

RePoly wants to build one of Australia’s largest plastics recycling facilities in the Southern Highlands — in a bushfire-prone area, within the Sydney Drinking Water Catchment.

A major fire wouldn’t necessarily stop at the factory boundary.

It raises serious questions about smoke, airborne contaminants, contaminated firefighting water and the potential for fire to spread beyond the site.

The community has already spoken.
The Independent Planning Commission rejected RePoly. Now RePoly is appealing that decision in the Land and Environment Court this October. This is our last chance.
We, as a community have already funded much of the legal fight, but to present the strongest possible case we urgently need to raise a further $97,000. Without these funds, we'll face difficult decisions about how many expert witnesses we can engage and the level of senior legal representation we can afford in court.
