Section 48(1) of the Constitution protects the right to life. The Termination of Pregnancy Act 1977 (as amended and the Constitution of the Land accepts that an "unborn child", is a life, and therefore enjoys the protection of its life, as it is actually a life, with its own rights separate from its mother.

In the absence of explicit constitutional authority for abortion, any interpretation allowing wide abortion access must be approached with caution. The proposed amendments stretch this interpretation by allowing termination of pregnancy on broad and subjective mental-health grounds, creating a risk of abortion on request in practice.

Issues of this magnitude - touching on life, family, national values, and public morality-require a transparent, democratic, and participatory legislative process. Judicial directives alone cannot resolve questions that shape our nation's identity and long-term social fabric. ZHOCD

The large majority of countries around the world protect unborn children. Almost all countries in Africa protect unborn children. Zimbabwe's law is already more liberal than the African average.

According to African.mapper "While abortions are legal at least under certain conditions in almost all countries, these conditions vary widely. According to a United Nations (UN) report with data gathered up to 2019,[42] abortion is allowed in 98% of countries in order to save a woman's life. Other commonly-accepted reasons are preserving physical (72%) or mental health (69%), in cases of r**e or in**st (61%), and in cases of fetal impairment (61%). Performing an abortion because of economic or social reasons is accepted in 37% of countries. Performing abortion only on the basis of a woman's request is allowed in 34% of countries.

Best Interest of the Child Must Guide Zimbabwe’s SRH Policy Debate

The SRH Movement welcomes the removal of Clause 11 from the Medical Services Amendment Bill. However, the broader debate around sexual and reproductive health policy in Zimbabwe remains unresolved.

While some policy proposals focus on expanding abortion access, we believe genuine compassion must prioritise prevention, protection, and the life of both the mother and the unborn.

Zimbabwe must address the social realities affecting young people while ensuring policy solutions strengthen families and safeguard children.

Zimbabwe is experiencing a sustained advance of a global Sexual and Reproductive Health and Rights (SRHR) agenda that increasingly conflicts with constitutional values, parental authority, child protection, and respect for life. This agenda has advanced incrementally - from the attempted 2019 Marriage Bill amendments and the 2020 petition seeking unrestricted SRHR access from age 12 to current abortion-related legislative and constitutional processes, including the Medical Services Bill before Senate.
