Civic Space Alert!

The Zimbabwe Republic Police (ZRP) have blocked a solidarity rally by Citizens Coalition for Change (CCC) politician, Job Sikhala, set for Saturday the 23rd of December 2023.

A grouping called the Job Sikhala Solidarity Council, which is behind organizing the rally, had notified ZRP of its intention to hold the event at Huruyadzo Community Hall.

The rally was meant to mount pressure on the government to release Sikhala, who has been in remand prison since June 2022 after being charged with inciting public violence.

In a letter addressed to the organisers, ZRP said the planned rally was a security threat as it did not meet the requirements of the Maintenance of Peace and Order Act (MOPA).

“The notification to hold a procession rally in solidarity with Job Sikhala at Huruyadzo Community Hall on December 23 is prohibited. The notification does not meet the requirements of section 7 of the MOPA Act. Therefore, your event was not sanctioned,” the letter read.

In response, the organisers of the rally accused the police of weaponizing MOPA to quash active demand of civil and political rights that include freedom of association and assembly.

Civic Space Alert !

The Zimbabwe Republic Police (ZRP) have called Takudzwa Ngadziore (Youth Quota Member of Parliament ) requesting submission of his Facebook account details (username & password) .

This follows a Live video that he captured almost a month ago whilst he was being abducted. Ngadziore was later found dumped, tortured and naked outside Harare after the abduction.

According to Ngadziore on his X account, the ZRP asserted that ,”We want to download the video (evidence) from the source, for us to deal with the matter you reported.”

Civic Space Alert !

Former Harare mayor Jacob Mafume has been re elected as the Mayor of Harare. Marine defeated Elvis Ruzani by a vote of 22 to 15.

Mafume, a lawyer, previously served as mayor from 2018 to 2023.

The position became vacant when Lovejoy Chitengu, who had replaced Ian Makone, was recalled. This is after the mayoral seat was left vacant due to the departure of Lovejoy Mandengu, who was recalled from office.

Mafume was sworn in on Thursday 21 December 2023 at Town House.

Civic Space Alert !

Job Sikhala, appeared at the Harare Magistrate’s Courts on Thursday 21st December 2023 at 10am. He was accompanied by the Chitungwiza Mayor Lovemore Maiko.They are both being charged with inciting public violence at Zengeza in May 2022. The matter was postponed to the 3rd of January 2024.

Interim secretary-general Sengezo Tshabangu on an interview on The Breakfast Club, tells local journalist Zenzele Ndebele of the Centre for Innovation and Technology that the Bulawayo mayor David Coltart "can have good sleep because he no intentions of recalling him".

Tshabangu says that he is fighting candidates impositions that happened within the party by recalling some MPs, senators and councillors.

0n 20 December 2023, Pious Mukandi alias Jamba has been jailed for 30 years for killing CCC activist, Moreblessing Ali last year.

The High Court is this afternoon handed a sentence to murder convict, Mukandi alias Jamba, who was last week found guilty of killing Ali.

Job Sikhala remains in pretrial incarceration after he advocated for a dignified and decent burial of Moreblessings Ali. He is set to appear in Court 18 at the Harare Magistrates Court for judgement on the matter in which he was charged with peddling falsehoods with Lovemore Maiko, tomorrow 21 December 2023.

Finance Minister Mthuli Ncube, has been forced to increase the budget allocation for Parliament to please the MPs.

There shall be an increase in the budget allocation for Parliament so as to win over legislators after they threatened not to pass his ‘anti-poor’ budget.

Members of Parliament (MPs) demanded top-of-the-range Toyota Land Cruiser vehicles, hotel stay for their spouses, huge perks, additional benefits as well as payment of salaries for their workers.

They complained about their welfare which they said did not match their counterparts in the Southern African Development Community region, adding that they were a laughing stock in their respective constituencies.

“I propose that we increase the budget for Parliament by another ZWL$225 billion so that it becomes ZWL$700 billion in response to those needs,” Ncube said on Thursday.

“There was a question specifically about vehicles, we have budgeted ZWL$132 billion at the current exchange rate, which converts to about US$60 000 per vehicle.

“We have done that but I think the main issue is that we increase the budget for Parliament to ZWL$700 billion.”

Ncube also proposed to increase the Constituency Development Fund (CDF) budget allocations.

Legislators representing 210 constituencies have access to CDF, which is allocated by Treasury to initiate development projects. Government introduced the CDF in 2010.

“I am aware that we need to increase the budget for constituency offices and constituency visits. Also, in the past, we have talked about research officers to support MPs and also to bolster the CDF. We have done some calculations with my staff,” Ncube said.

He told legislators that the facility for the importation of their vehicles, including those from the Ninth Parliament, is still in place.

“I must say that the facility for the second vehicle is still in place, so you are free to import a second vehicle. Those from the Ninth Parliament who could not bring in cars before Parliament was dissolved, we are going to extend the Statutory Instrument so that you can bring in your cars,” he said.

“I have already received a letter through the Clerk of Parliament of members who were affected. We are processing that as Treasury.”

“In terms of Parliament staff, they also have access to duty free motor vehicles just like any other civil servant.”

Ncube said there was need to have a committee to put together a decent welfare package for the MPs to ensure they enjoy a decent lifestyle.

“We can identify land and once that land has been identified, we take some amount and deposit with a building society and build accommodation for our MPs. They are given a key and they use that during the duration of Parliament.”

He added: “That is what should come to the welfare committee for discussion so that we all agree on the best model and the government stands ready to support.

The MPs argued that US$60 000 was not sufficient to purchase vehicles of their choice.

In December, MPs were pampered with US$40 000 housing loans that divided public opinion countrywide.

The housing loans caused fissures within the opposition circles especially the Citizens Coalition for Change after its leader Nelson Chamisa criticised MPs from his party for accepting the money which he described as a bribe from the Zanu PF-led government.

Government offered a US$40 000 loan to each sitting MP, US$500 000 for individual Cabinet ministers and their deputies.

Sengezo Tshabangu condemns and threatens action against unruly CCC MPs who disrupted the parliamentary sitting a few weeks ago.

Tshabangu asserted that their behavior was uncalled for and he will be engaging parliament to ensure that individuals are put into line. Action will be taken to align them to the dictates of democracy.

“There are a few individuals who really need to be put in line. There are still individuals who still believe that parliament is the fighting space to throw stones.”

“The recalls are not initiated by an individual or a group of people but they are initiated by the party as a collective. If the party decides that recalls are no longer serving the purpose and that recalls have responded to the issues raised, we will be guided by the party.”

He was heard this in a video that was aired on ZBC TV during the 8pm news on 19 December 2023.

Three CCC by election candidates have filed their
nomination papers as independent candidates.

The constituencies they shall represent are Chegutu West, Seke, and Zvimba East . They filed as independents so as to avoid disqualification from the by elections tabled for 3 February 2024.

Filing as independents is in contradiction with the party’s insistence that its candidates file as CCC candidates.

This is also deployment of a different strategy as that was deployed by the other three recalled candidates, namely, Gift Ostallos Siziba, Stephen Chagwiza and Amos Chibaya who all filed as CCC candidates ahead of the by-elections next year.

Admore Chivero, Willard Madzimbamuto and Oliver Mutasa filed as independent candidates respectively in Chegutu West, Seke and Zvimba East,

Siziba, Chagwiza and Chibaya are running for the Pelandaba-Tshabalala, Goromonzi South and Mkoba South constituency seats respectively.

Civic Space Alert !

On 18 December 2023, the Zimbabwe Electoral Commission (ZEC) ascented to instructions from CCC President Nelson Chamisa, outlined in a letter addressed to the Chief Elections Officer in Harare.

Shava Law Chambers, representing Chamisa, voiced concern about the unapproved utilization of Chamisa’s face image by individuals not officially sanctioned.

Quoting the letter, Chamisa’s legal representatives clarified that specific CCC candidates had been granted consent to feature Chamisa’s face as a logo during the August 23 to 24, 2023 harmonized elections.

However, the letter revealed that some unauthorized individuals had illicitly appropriated Chamisa’s image for potentially misleading purposes, intending to use it on nomination papers.

The letter strongly emphasized the illegality and fraudulent nature of such actions, asserting, “Any unauthorized use of our client’s face constitutes a violation of his constitutional right to privacy as well as compulsory deprivation of his property rights.”

Shava Law Chambers explicitly warned the Zimbabwe Electoral Commission not to accept any nomination papers bearing Chamisa’s image, except for those specifically authorized in the June 15, 2023 letter.

The legal representatives also conveyed Chamisa’s intent to take legal action against anyone found using, accepting, or permitting the unauthorized use of his property.The unfolding situation adds complexity to the political landscape, prompting questions about the repercussions for candidates who may defy these legal directives.

Civic Space Alert !

On 18th of December Nomination Court sat to receive nomination papers to fill vacancies created by the recall of an additional six Citizens Coalition for Change legislators from Parliament.

The six constituencies that will hold by-elections are Pelandaba, Goromonzi South, Seke, Chegutu West, Zvimba East and Mkoba North.

The Nomination Court sat at Tredgold Magistrates Court Building in Bulawayo, Marondera Magistrates Court, Chinhoyi Magistrates Court and Gweru Magistrates Court.

There have also been recalls in Senate, Proportional Representative MPs, and local authority and this means that elections to replace those office bearers will be held in terms of the prescribed law that relates to them.

Other PR legislators that were recalled include Emma Muzondiwa (Midlands proportional representative), Machirairwa Mugidho (Masvingo proportional representative), Constance Chihota (Mashonaland East proportional representative), Monica Mukwada (Manicaland proportional representative), Sekai Mungani (Midlands proportional representative), Linnet Mazingaidzo (Harare proportional representative) and Daphne Gutsa (Mashonaland East proportional representative).

Those recalled from the Senate are Webster Maondera, Jameson Timba and Vongai Tome, all from Harare, and Editor Matamisa and Ralph Magunje from Mashonaland West.

Despite the risk of disqualification, former legislators from the Citizens Coalition for Change (CCC) successfully filed for nomination to contest the upcoming February 3 by-elections under the banner of the CCCparty.
