I ............................... lobby you in my capacity as a constituent in the........................... Constituency and also as a citizen of the republic of Zimbabwe, to express to you as my elected official and legislator, my utmost grave concern at the manner in which the Government of Zimbabwe seeks to pass into law, the omnibus Constitution (Amendment) Bill 2026, No 3 of 2026. The bill has far-reaching and unpredented consequences for the lives of Zimbabweans and their hallowed decedes-old democracy.
The Constitution is the supreme law of the land. It is the foundation on which all laws are made. It's review and should be transparent, all-encompassing, and inclusive. It should not be hurried particulary in our case as it is the first post-independence exercise. While the Constitution should be responsible to changes as they emerge, such changes should not weaken nor undermine our long-term national values and aspirations.
The Government of Zimbabwe seeks to enact into law constitutional changes with prior extensive nationwide engagement with Zimbabweans, including the conduct of a constitutional referendum. Zimbabweans have the right to contribute to the second republican people driven Constitution.
Amongst the proposals in the Constitution (Amendment) Bill 2026, Bill No: 3 of 2026 are; changes to the extension of presidential, Parliamentarians and Councilor's term to 2030, the changes in the appointment of Judges of our law courts which will make it less transparent and give the President more discretionary powers in their appointment. The judiciary is our last line of defense it offers the sacred protection of every man and woman. The influence of the Executive should be limited. There are other provisions that in our view have not been canvassed for and endorsed by Zimbabweans.
Protecting the rights of Diaspora vote is welcome but should be provided for through an ordinary Parliamentary statutory bill through which elaborate and well-articulated processes and procedures will be promulgated. The said law would guide the processes of Diaspora vote from passport to the termination of the procedures to establish the person's identity. This will cause the amendment of the Electoral Act to accommodate the circumstances of the Diaspora person's.
The above issues are not exhaustive. In my view, Bill falls far too short for a real people's informed process. Zimbabweans has been shortchanged by the Bill. Zimbabweans crave for the independence of oversight institutions; continues direct election of the President; predictable election date; one man one vote etc etc.
I, therefore, urge you to support my views and be audible and loud enough to be heard in the rejection of the Bill, should the government not voluntarily withdraw it for engagement and consultations to afford Zimbabweans their inalienable right to shape their national constitution. I will be listening and watching
