Chief Justice Allows Lawyers and Clients to do cases on‘ ’

In a groundbreaking reforms, the Chief Justice of Zambia has approved a law that will allow lawyers to represent clients on contingency fee basis or “ ” and only pay when they win the case.

Until yesterday 11th July, 2025, lawyers in Zambia were not allowed to take up cases on (contingency fee) arrangements and this affected poor people who could not afford legal fees but had good cases.

Chief Justice Dr. Mumba Malila, SC has approved “The Legal Practitioners’ Practice (Amendment) Rules, 2025”, which is Statutory Instrument No. 50 of 2025, that has now allowed / contingency fee arrangements.

The new law will allow clients - especially those who cannot afford to pay legal fees upfront - to agree with the lawyer to pay once they win the case and get paid.
“A provision of a contingency fee arrangement that does not comply with these Rules shall be invalid and unenforceable,” the Rules read.
Law Association of Zambia (LAZ) will have powers to review the contingency fee arrangements upon request by the client so that the fees are not “unconscionable”, “unreasonable” or does comply with the law.

but Go and sue from High Court .

LATE former Minister of Finance and National Planning Ng'andu Magande’s daughter, Namweemba, has sued three of her late father’s administrators over alleged unfair distribution of his estate.

Namweemba Magande wants the Lusaka High Court to grant her an order compelling the administrators and administratrix to render an account for the full inventory of Dr Magande’s assets.

The 38-year-old plaintiff also seeks an order compelling the administrators to distribute her late father’s estate to the rightful beneficiaries, including herself.

Namweemba, who submits that she was born out of wedlock, filed the lawsuit as the beneficiary of Dr Magande’s estate.

“The plaintiff was born out of wedlock on February 5, 1987 at Livingstone General Hospital from Ng'andu Magande and the late Ruth Pelekelo Sitali, who died in 2013.

The first defendant in the case is Simwaale Magande, while Joyce Mudenda and Nakanjoli Magande, co-administrators, are second and third defendants respectively.

Namweemba submits that she was at all material times a beneficiary of the estate of Dr Magande, who died intestate (with no will) on October 22, 2023 after an illness at Maina Soko Military Hospital, Lusaka.
