Big news: the court has ruled in favour of ECD practitioners!
The Pietermaritzburg High Court has declared the non-payment of ECD subsidies in KwaZulu-Natal unlawful and unconstitutional — and recognised, for the first time, that all children in South Africa have a right to early childhood development.
The Department of Education must now report exactly which centres are owed money, pay every outstanding cent within a month of reporting, and continue to report every three months until the debt is cleared.
This win belongs to the ECD practitioners who kept showing up, even when they were not being paid. To the centres who refused to close their doors. To everyone who stood with this movement.
We are grateful to the persistence of the applicants, Friends of South Africa Early Childhood Development, the KwaZulu-Natal ECD Alliance, and three KZN-based crèches, supported by the Women's Legal Centre for their resolve to hold KZNDoE to account.
But the fight is not over — now we make sure the government keeps its word. Stay close as we watch this through to implementation.
Tune in to SAfm at 21:00 tonight and hear Tshepo Mantjè talk about the ruling and what is means for children’s right to Early Childhood Development.
