*COURT GRANTS INTERDICT: JUDGE KUSEVITSKY ORDERS MUNICIPALITY TO PROVIDE SERVICES TO PINEVALLEY COMMUNITY*
We note and welcome the court order granted by *Judge D.S Kusevitsky of the High Court* on 28 April 2026 regarding the matter of land occupation in Smutsville.
We are thankful for the courtโs balanced decision. The order confirms that:
1. Only occupiers listed on the joint list as at 24 October 2025 may remain on the erven
2. No new structures may be erected and no property may be damaged or removed
3. The Applicant is ordered to provide *ablution facilities on the erven* pending relocation of Respondents, in consultation with the Western Cape Minister of Local Government and the Minister of Human Settlements
4. The Applicant must also provide a report and list of *emergency temporary alternative accommodation* for those occupiers who require same by *31 July 2026*
We now call on the *municipality and relevant government departments* to urgently comply with the court order and provide the services as stated. Basic human dignity demands access to ablution facilities and emergency accommodation for vulnerable families while long-term solutions are finalised.
We remain committed to a lawful, peaceful, and humane resolution that respects both property rights and the constitutional rights of all parties.
