LEGAL WARNING TO WHATSAPP & FACEBOOK GROUP ADMINS
ILLEGAL PUPPY SELLING – SOUTH AFRICA
Public WhatsApp and Facebook groups can be held legally liable in South Africa if they allow the illegal sale of puppies to take place — even if the group rules or description say it is not allowed.
Disclaimers do not protect administrators.
The law focuses on conduct, not posted rules.
ADMIN LIABILITY UNDER SOUTH AFRICAN LAW
Under the Cybercrimes Act 19 of 2020, any person who intentionally or negligently allows unlawful content to be distributed, or who fails to remove such content once aware of it, may be regarded as part of the “chain of publication.”
This applies to WhatsApp and Facebook group administrators who:
• allow illegal puppy sale posts to remain visible
• fail to remove or block sellers
• ignore repeated or ongoing illegal activity
• fail to act after the illegality has been pointed out
• do not report unlawful conduct once aware of it
Legal interpretation is clear:
Once an admin is aware of illegal content, a legal duty to act arises.
Failure to act may amount to facilitation or enabling of criminal activity.
WHY PUPPY SELLING IS OFTEN ILLEGAL
Illegal puppy selling is not a minor offence. It is commonly linked to animal cruelty, fraud, and unlawful commercial breeding, and is governed by multiple laws:
Animal Protection Act 71 of 1962
Sections 2(1)(a), (b), (e) and (f) make it a criminal offence to:
• cause unnecessary suffering
• fail to provide veterinary care
• sell animals in a manner that causes harm or neglect
• breed animals irresponsibly
Selling puppies that are unvaccinated, underage, sick, or bred without proper care constitutes a criminal offence.
Municipal By-Laws
(May vary by municipality, but generally prohibit:)
• breeding animals for sale without registration
• selling animals without permits
• exceeding the permitted number of animals per PROPERTY
By-law violations are CRIMINAL offences, not civil matters.
Consumer Protection Act 68 of 2008
Selling puppies as a form of trade requires:
• lawful business registration
• honest disclosure of health and age
• compliance with animal welfare legislation
Failure to comply may amount to illegal trading and misrepresentation.
⚖️ ACTIONS MATTER — NOT DISCLAIMERS
If a WhatsApp or Facebook group becomes a platform where illegal puppy selling occurs and admins do nothing, the admins may be viewed as enabling the illegal activity.
Admins protect themselves only when they take active steps:
✔ immediate removal of illegal posts
✔ removal or blocking of the seller
✔ issuing a clear warning
✔ reporting the activity to the SPCA, municipality, or SAPS
Ignoring posts, “missing” them, or relying on group rules is not a defence.

WhatsApp and Facebook groups are not law-free zones.
Allowing illegal puppy sales — or turning a blind eye — can expose admins to criminal investigation and possible charges.

Act immediately, or accept the legal risk.
The law will not ask what your rules were.
It will ask what you did.
