SUBJECT: Nokwanda Patocka GBV Foundation Responds to Judge President Mbenenge Judgment: “Do Not Let This Verdict Silence the Vulnerable.”

The Nokwanda Patocka GBV Foundation notes the recent ruling by the Judicial Conduct Tribunal, which found Eastern Cape Judge President Selby Mbenenge not guilty of gross misconduct and s*xual harassment. While we respect the judicial process and the findings of the tribunal, we view the broader implications of this case with deep concern for the future of workplace safety in our province.
Our primary concern is that this outcome will be weaponized by perpetrators of s*xual harassment to intimidate, gaslight, and discredit victims. We have already seen a disturbing trend in the Eastern Cape where "s*x for jobs" and workplace harassment are treated as open secrets.
We warn against any narrative that uses this specific case to suggest that s*xual harassment claims are falsified by default. Such a narrative creates a chilling effect, discouraging women—particularly those in junior positions—from coming forward against powerful men.
We note that while Judge Mbenenge was cleared of gross misconduct, the tribunal did find him guilty of a "degree of misconduct" for initiating a flirtatious relationship during work hours.
According to the Code of Judicial Conduct: Article 5.1 states that Judges must always act honorably. This reinforces that even if it wasn't criminal harassment; it was still a failure of leadership.
