Apartheid enforcers and collaborators wielding legal processes as imishini yabo to destroy the implementation of the National Health Insurance Act to kill attainment of health justice - writes Mabalane Mfundisi

South Africa stands at a defining moment in its democratic journey. The NHI Act did not emerge overnight. It followed (a) Over 20 years of policy development (b) Green and White Papers processes (c) Extensive public consultations (d) Parliamentary hearings in 2019 and 2022 (e) National Assembly and National Council of Provinces deliberations and majority adoption in 2023 and (f) Presidential assent on 15 May 2024. With all the above, South Africa took a decisive step towards fulfilling one of the most sacred promises of 1994: dignity, equality, and justice for all through provision of universal health coverage. Immediately when the democratic process was completed, those who are guided by their apartheid past as enforcers and collaborators vowed to use the courts to reverse the will of the people as expressed through democratic processes of parliament...

C20 International Advisory Committee (IAC) is currently working out modalities of handover from C20 South Africa to C20 USA

The C20 International Advisory Committee (IAC) met today, 2 December 2025 virtually to take stock of the work of C20. The meeting reflected on the process of handover from the South African government to the government of the United States of America. Processes that relates to governments in terms of the G20 are in the realm of governments and the C20 is ceased with matters of civil society and the focus of C20 is in this area of its focus. The IAC commended the great work done by the C20 South Africa and how this work whilst independent, demonstrated cooperation and collaboration with the South African government and governments of the G20. Such collaboration is demonstrated by the C20 Declaration that found expression in the G20 Leaders Declaration. The IAC also wishes the USA government success with its G20 Presidency and promises to ensure that C20 USA will be equal to the tasks, challenges and opportunities that lie ahead.

The IAC meeting focused on 2 issues which are outlined below:

1. Receive a report of the Chairperson, Sherpa and the Secretariat of the C20 South Africa on work done in 2025. The IAC expressed messages of congratulations on the great work done despite the odds that the C20 South Africa Presidency had to navigate.

2. Discuss modalities to handover to C20 USA. To ensure a stronger voice for C20 going into the C20 USA, civil society role-players have to act with unity, purpose and commitment with the lead organization(s) driving the C20 towards success.

The meeting was addressed by the C20 South Africa Chairperson, Thulani Tshefuta and officiated by the C20 South Africa Sherpa, Mabalane Mfundisi. The meeting was attended by various members of the International Advisory Committee members.

In his address, Tshefuta said "We put our best foot forward to ensure C20 deliver a Policy Pack and Declaration. We also hosted a C20 Summit. C20 also contributed to the success of the G20 Social Summit both in terms of participation of delegates where over 65% of delegates were drawn from C20 and through our representatives, we shaped the Declaration that emerged. These and other actions we undertook is what defines success for us as C20."

The IAC resolved as follows in terms of the next steps towards C20 USA:

1. Another meeting will be held on Thursday, 4 December 2025 to finalise which organization(s) from the USA will be announced as the host(s) of C20 USA. Once finalised, a media handover from C20 South Africa will be undertaken to announce the C20 USA host.

2. To ensure civil society is strengthened, the IAC will embark on a process to review the C20 Principles to ensure strengthening the governance and management of C20.

3. The IAC reaffirmed the C20 South Africa Legacy projects that are as follows:

3.1 Strengthening civil society coordination through the launch and operationilasation of Civil Society South Africa (CSSA). This will build on the fact that C20 South Africa was able to mobilise over 3000 organizations that registered on its database.

3.2 C20 South Africa through the Chairperson and Sherpa will continue to participate in the IAC and in this regard discharge the Troika responsibilities of connecting South Africa as former host, USA as the current host and United Kingdom as the next host in 2027. This process will provide a platform for continuation of the South Africa, Africa and global civil society role-players in the journey of C20 USA especially in terms of linking the Policy Pack from South Africa to the new priorities that C20 USA will outline.

3.3 The C20 South Africa Sherpa will present a number of Legacy activities that will be determined from the C20 South Africa Declaration that have found expression in the G20 South Africa Leaders Declaration.

In the spirit of one, united and prosperous civil society, the meeting of the IAC on Thursday, 4 December 2025 will see the attendance of previous leaders of the C20 including but not limited to Brasil, Japan, Italy who for one reason or another had opted not to participate in the C20 Presidency of South Africa. This is a welcome development as C20 gears towards the turbulence that the G20 USA is expected to navigate.

National Health Insurance (NHI) has been enacted as an act in the Republic of South Africa as at May 2024. An act requires implementation from the President to Ministers including Minister of Finance because anything to the contrary means sedition unless the act is is nullified by the Constitutional Court.

After reading this article below, after understanding the seditious acts of the Minister of Finance, a reader on social media exclaimed *"I just can’t fathom how the Minister of Finance can take this line which is so blatantly at odds with official government policy"*

In a democracy, a President will fire such defiance from a Minister or Deputy Minister. In June 2025, President Ramapahosa fired a Deputy Minister Andrew Whitfield because he had defied him. Afterall, Andrew Whitfield, former DA Minister in the GNU was fired for a lesser act of defiance by President Cyril Ramaphosa. The President announced that *"Mr Whitfield was removed as a Deputy Minister because he undertook an international visit without the permission of the President."* This pales in comparison to what Minister Godongwana has done in sabotaging implementing an Act of Parliament and will of the people of the Republic of South Africa.

Defiance is defiance and it must have consequences. This defiance is akin to collective punishment to deny them the right to access to quality health.

This defiance makes a mockery of the political and policy decision of the ANC and the South African government's G20 Declaration component on health. It means the ANC is a paper-tiger, full of pronouncements but lacking in implementation. Such defiance cannot be left unchallenged. If left unchallenged by the President, it means the President acts on defiance of his authority by his/ her Ministers and Deputy Ministers depending on who is involved.

In the days, weeks and months to come, pressure must be brought to bear to demonstrate who holds power to ensure the NHI as a form of universal health access - does power lie with the Minister of Finance or with the President or with the ANC or with the people who daily suffer the inequalities brought about by the current health system and its financing model. Alliances must be forged to start acting and stop speaking.

REGISTRATION TO PARTICIPATE AND ATTEND THE NATIONAL DIALOGUE

The C20 South Africa 🇿🇦 is firmly behind the National Dialogue processes. We have 1 South Africa and to fix it, we need dialogue. Dialogue about challenges and problems is never easy, but those involved must be ready to listen, to articulate, to compromise, to scream, to be screamed at, to be angry and ultimately to sing and laugh when a solution solution solution is placed on the table. That is what the National Dialogue on the 15th August 2025 will provide - a platform for robust engagement to shape the South Africa that CODESA could not deliver. South Africa is our perfect imperfection. We owe it to those who paid with their lives for us to enjoy the freedom we enjoy today. It was not easy and it remains not easy, but it has to be done by us all to make it easier.

We are not surprised that some who place their narrow sectoral interests above those of the majority of South Africans have decided to eject themselves form the preparation and attendance of the National Dialogue. Their privilege has made them spoilt brats who think without them nothing will happen. Unlike those foundations, our resilience is built on strong foundation that is never going to be defeated. Just like the AWB and their Afrikaner ilk, the Bantustan leaders and the IFP who were opposed to CODESA, who did everything to derail negotiations from taking place, at times unleashing violence, we must defeat these foundations without a foundation and create the building blocks towards a National Dialogeu that will deliver a Social Compact for a prosperous South Africa.

On 10 July 2025, Caster Semenya won her case at the European Court of Human Rights. When all else fail, sometimes the law is the only way to find justice... Humanity, like Caster sometimes we are made to endure injustice and you either submit or you fight. The same applies to organisations that are put in so much calamity by others who have deep pockets. We stand with, behind and in front of LGBQTI+ persons and we will use all we have to fight for their human rights that we must ALL enjoy.
